at the afternoon session growing: out of the tVial of Baldy Davis et including two Chinamen, on a charge of violating the Sunday Judge Feagin discharged all the defendants except Davis, and he was finally released. When this was done Chief Austin said: I am going to let the people know why the law is not enforced. I have done my duty, and I want others to do theirs. We had evidence enough to justify a conviction in that case, and there-is no use to bring a man up here you are, going to turn him loose lijje that. I am going to see that th' know men are nej, yipvieJW The Judfi sim posed a fine of $10 for contempt, I' hereupon the Chief told the Judge cJ impose more if he desired.

The Judgedid impose another fine, and requested Capt. William Weir to take thrift man to jail. Captain Weir beggaQ to be excused, saying that Chtyq Austin was his superior officer apcl he could not arrest him. The Judge stated that be had Jurisdiction over his court, and that the officers were officers of his court. The Chief left the room.

lie stated afterwards that be had no apologies to make for the statement made in the court room. There was some mention made about proceedings against the Chief. WENT TO CHIEFS HOUSE. About midnight last night Jewett Feagin. aged about 21, son of Judge X.

B. Feagin, of the Inferior Criminal Court, called at the house of Chief of Police Austin and requested an lnter-xiew. Officers Cole and Devine and Mr. John G. Bradley were with the young man when the call was made.

It was evident that trouble was about to occur. The two officers were detailed on the case by Captain Weir because of the suspicious actions of the young man. At the residence of the Chief, Officer Cole called the Chief to the door and told him Mr, Feagin wanted to ee him. Beforehand the Chief was warned that there might be trouble. The Chief bad no weapon, but received the gentlemen in his night clothes.

Mr. Feagin asked for a private interview. Into the parlor Chief Austin led him and the door was closed. Dont you think you owe my father an apology, said Mr. Feagin to the Chief, or words to that effect.

Well, no, said the Chief. Well, I think you do, replied Mr. Feagin. The Chief stated that every one was entitled to his opinion. Mr.

Feagin then asked what had happened between the Chief and JAdge Feagin. whereupon the Chief told him to go and ask bia father as to what had happened. HIT IN THE FACE. Mr. Feagin then reiterated that he believed an apology was due his father and it Is stated made an effort to run his hand down his pants pocket in front.

Before he could put his bam! in the pocket Chief Austin hauled back and struck the young man in the race and with the other hand grabbed the young mans arm. The tussle attracted the attention of Mrs. Austin and the officers on the outside ran in just in time to witness part of the difficulty. Young Feagin was placed under arrest In his pants pocket in front was a brand new pistol which had never been fired. Chief Austin SEE OOB DEW BBRIVflLS IN HEGKWEHB, FBJiBY B8LF BOSE, STBBW BATS.
