Judges Juhtsot and Drayton presiding came on tilt trial of Charles Owen an American formerly mariner on board of the seltr Mann of Portsmouth Nev-Htmpshire charged with feloniously and pirutically steal-and running away tyilh the hunt of the iid vewel and carrying with him a chest of the owner of said vessel containing $2300 iu specie The circumstance took place on the roast of St Domingo when Uapt Rogers and his brother the anpercargo owners of the vessel Bnd property ere on ursdit having been made the acrused was arrested and secured by tlie Government of layti which with a proper comity delivered him up to the American authorities and ie was brought here in one of our national vessels Mr Rogers young gentleman of respectability actuated by public spirit and an honorable sense of duty came hither from Portsmouth New-Hampshire to give evidence in support of the jffosecution which he accordingly did IJis evidence included the confession of the accused on whorawas found $800 of the money carried off The facts being clearly established and not disputed the counsel for the prisoner Mr Holmes very ingeniously urged the following points of defence 1st He contended that the offence was committed within tlis territorial jurisdiction of Hayti in one of the harbors of St Domingo and that as it was not a place ithin the admiralty jurisdiction of the States it was not therefore within tlie jurisdiction of the United States for the purpose contended for idly The counsel contended that Spanish silver dollars were not included in the term nor in the term used in the clause of the statute under which the pri soner was indicted Silly That the offence of the prisoner was larceny and not breach of trust which the laws intended to punish that if it was larceny it was not punishable by the laws of the United States which punish larceny only on the high seas bul by the laws of Hayti only To these objections Mr Gadsden having made an able reply the Court deferred its decision until the next day (Saturday) when the Court being convened Judge Johnson overruled all the objections of the counsel He observed that tlie jurisdiction of the United States over American vessels and their crews was not as was contended limited to the admiralty jurisdiction that under the power to regulate commerce given by the Constitution the Congress of the United States in the exercise iff the commercial relations of the United States necessarily required th power to control vessels and mariners sailing under the American flag wherever those vessels were That it was true the Dayman Government had a right to try the accused for larceny That perhaps a summary trial nn the spot would have as well answered the purposes of justice being in the vicinityj too of the place where the crime was committeiij as the sending of the prisoner to be tried here But the Court had no doubt of the jurisdiction of tlie United States in tliis case the vessel being American and the accused a citizen of the United States and therefore tlie objection on this point was overruled On the second point whether money id est silver Spanish dollars could he regarded as or as the Court traffic and of exchange Their value varies every day iu various places In foreign and domestic prices current you nlwnys find their relative value noted for the information of merchants Iu the East India trade as well as others they constitute tiie chief article of commercial exchange so that money is not only the means but has become in many instances the subject of traffic Silver dollars are therefore embraced in the term and this objection is therefore overruled It is contended 8d by the counsel that tlie accused has committed larceny only and that clearly not punishable by tlie laws of the States because not committed on the high seas If tlie Court wal convinced that he liad committed no more than larceny it would not allow the proaecution to he carried on under another issue as if for a different offence But it is too clear A-onri the facts iu this ease that a breach of trust the offence contemplated by tlie law was committed in tliis instance 1 to wit the running atraj with
