brings to tulnd the glorious boom days of the later eighties tvas decided by Judge Estill in circuit court yesterday The style of the case was Mullane vs Charlotte Malcombe alias Morten charged with being an unlawful retainer of certain property at St Elmo The complainant was represented by It Zwinam the defendant by Col Tomlinson Fort and A Smith The case was tried two weeks ago Judge Estill having it under consideration since that time The facts are as follows: In 1837 when Chattanoogas future loomed even more glorious than now Mr Mullane a railroad man now living at Somerset Ky purchased the town lot in question paying about a1500 for It Mr Mullane would in all probability dispose of It now for 1400 of $500 one third of its original cost After purchasing the property Air Mullane erected a mai house on It and rented It to other parties After a while the tenants left the place and it went to "rack" The Interesting aftermath of the boom came on and It was found Impossible to rent the property In 1894 Charlotte Malcombe a negro woman came to Mr Mullane's agents and asked permission to live on the property She was permitted to do so but claimed that she would pay no rent unless the shanty as repaired Not thinking this worth while the agents refused to do so but allowed her to occupy the property under their charge without paying rent- The property was well nigh forgotten until recently however and the woman herself did not know who the owner was Mr Mullane remembered his Investment however and at last got an opportunity to sell It An obstacle In the shape of his free tenant arose In the pathway of the sale however the woman claiming that the property be longed to her from the fact that she had lived non it without paying any rent whatever for about seven years The matter was taken Into the courts the woman claiming the property to be hers according to the statutes of limitation There were a number of legal points InVolved however that in the opinion of Judge Estill the plaintiff and his attorney did away with the "statute of limitation" plea and the case was decided in favor of the plaintiff It was somewhat complex however and Judge after hearing charges of cruelty and mistreatment of firemen and their families last night found Redell guilty and his dismissal is the result Redell's attorneys gave notice of appeal In compliance "lth the recent ruling of Judge Estill in regard to justices trying cases at night the East Ninth street justices who did much of their work at night are now trying cases only in the day time confining partles arrested in jail on mitimuses until the following day The constables on account of the ruling are not attempting to do night work to any extent at present and respond only when called Squire Andy Ware in speaking of the situation today said: "I and the other justices are adhering to Judge Eatill's ruling although it don't appear in the least to have been a wise one to me A glance at the burglary and highway robbery reports appearing in the papers of late Will prove that the ruling was an unwise one This epidemic started directly after the ruling was made public and bids fair to continue some time unleos the constables again get to work The police force can hardly cope with the proposition though it is doing unsually well This is no discredit to the force however as it is without doubt the best force south of the Ohio river and proves the truth of my assertion on many occasions The force however is not large enough to meet the demands Each patrolman has a beat large enough for two men and a thief can watch his chance and commit any kind of depredation after the officer passes the point at which he intends committing the I crime They leatn the beats of the men and the sight of a blue uniform always alarms them On the other hand a constable can lie in wait for the miscreants at any time and at any place without detection A patrolman is forced to patrol his beat and has no opportunity for watching a suspected place for any length of time This epidemic of robberies is a direct result of the ruling "Another argument against the ruling is that the trial of a case costs almost twice as much as heretofore When it is necessary to arrest a man at night place him in jail on a mitimus and try him next day the cost in the average ease to the county is $1110
