been had he not been killed before he had attained an age wtien he would have had an earning capacity In a of like kind In New York in which the jury returned a verdict of six cents damaged against an electric line for causing the death of a lad the courts set the verdict aside on this very ground and granted the petition of the plaintiff for a new trial Now Justice of the supreme court of New York -county has taken similar action In a case "brought against the Metropolitan Railway oompany which was sued for having caused the death of a five-year-old boy The jury found for the plaintiff and fixed the award for damages at $300 Justice refused to this verdict to stand declaring that it was grossly inadequate and -unjust He showed that In this case after deducting funeral expenses and other uncontested special damages there remained only about $100 as the value of a human life He then went on to say: terms will tie imposed as a condition for a new trial The verdict Is perverse and the
