integration of the public schools of this state is detrimental to the public interest" Later he also alerted National Guard units for use in Birmingham "just in case they're needed" The governor claimed in his orders that "integration of the public school will totally disrupt and effectively destroy the education process There was no doubt in the minds of anyone that Wallace had challenged and defied the Federal government on school integration His executive orders which he used last week to delay school openings on an integrated basis last week in Tuskegee and Huntsville were issued less than three hours before ClaSS time today The latest orders left situation in this shape: white pupils can enter and proceed with their studies but Negro children are barred from attending classes with them The latest gubernatorial decree bore down hard on theory that the entry of Negroes would abridge the civil rights of the white pupils "and deprive them of equal protection of the laws" The new Wallace course seemed to be following a decision by Federal Judge Frank Scariett in a Savannah Ga school desegregation case earlier this year Scarlett ordered segregation continued but was promptly reversed by the 5th US Circuit Court of Appeals The case has been appealed to the US Supreme Court Wallace and a group of attorneys who appeared with him on a statewide television network Sunday night pointed to the Scarlett ruling and said the issue of inter-racial schools still was in the courts They denied that the 1954 Supreme Court decision voiding public school segregation is "the law of the land" 1 The governor said as he did by the Alabama Constitution and state laws to issue such executive orders "I George Wallace as governor of Alabama do hereby order and direct that no student shall be permitted to integrate the public schools of the City of Birmingham Ala his order for that city read The two orders for Mobile and Tuskegee read simillarly Judge Postpones tione it would be your duty to make a thorough investigation and to return a 'true bill' or 'no true bill' according to the law and evidence in the case" "There is no excuse for a person to imbibe intoxicating liquors to the extent that he becomes under the influence of them and then operate any motor vehicle upon the highways or streets of this state" Leathers declared "Every person who becomes intoxicated and drives an automobile is a potential murderer" into Violations" Leathers said "I trust that you will look into all violations of this section of the code carefully in order that this menace of drunken driving may 1) curbed" The new jury was told that one of the most "prevalent" violations of the gaming law was the numbers racket but it was explained other gaming violations included "betting on elections horse races or any other game of hazard" Concerning the traffic of obscene literature and photographs Leathers said it "has such a deleterious effect upon the morals especially of our youth and school children that I hope you will give any alleged violations your very careful attention" Members Named Named to the September term of the Grand Jury were: Morris Zager Ensworth Ave-flue
