Federal Power Commission (FPC) must fix rates for interstate sales of natural gas by companies which produce and gather it The issue arose when the commission after a lengthy hearing at Bartlesville Okla ruled 4-1 that it did not have authority to regulate sales by the Phillips Petroleum Co However thte US Court of Appeals for the District of Columbia reversed the commission and in a 2-1 decision ruled that the commission is required to fix prices by such firms as Itillips The FPC contended Phillips was not a natural gas company within the meaning of the Natural Gas Act and the commission thus had no jurisdiction over its rates Joining with Phillips in the appeal of the court of appeals ruling are Texas Oklahoma and New Mexico However the intervening parties and Michigan as well as Detroit Milwaukee and Kansas City and Wayne County claim Phillips is a natural gas company under the natural gas act and thus subject to regulation by the FPC US Intervenes Simon Sobcloff solicitor general for the Justice Department contended in a brief filed with the court that the purpose of the Natural Gas Act and its legislative history show that sales of natural gas by gatherers are intended to be exempt A brie filed by the Intervenors said that sales by Phillips occur after production and gathering have been completed and as a result Phillips should be regulated by the FPC The intervenors also contend that if Phillips is not regulated by the commission that prices will rise and it will cost consumers more for gas The intervenors say that Phillips is engaged in carrying natural gas from wells in Oklahoma Texas and New Mexico to 10 processing plants in Texas and New Mexico where hydrocarbons and other matter is removed Eisenhower to Attend Rivers and Harbors Meet WASHINGTON UP) President Eisenhower has accepted an invitation to attend a meeting of the National Rivers and Harbors Congress here May 23 The White ifouse notified Rep Brooks (D-La) vice president of the union reported for duty on the Tuesday morning shifts A company spokesman said that the first the company knew of the work stoppage was when long-distance operators scheduled to report at 7 am failed to do so riant and warehouse personnel scheduled to report at 8 am also failed to report as did union employes in the business office who normally go to work at 8:30 am When the workers arrived at the various offices they were greeted by other union members carrying signs saying "Union meeting now in Almost all of them went to the meeting which was held at Municipal Auditorium The Telephone company described the action as an "unauthorized work stoppage" and a union spokesman described it as "merely a union meeting" Roger Travis president of Local 3411 of the Communications Workers of America (CIO) said that the action was "not a strike" "We are not on strike" Travis said "We are merely holding a union meeting The right to hold such a meeting is guaranteed under the free assemblage and free speech sections of the US Constitution The meeting is to ad vise our members of the situation that exists They are here volun tarily on their own" Travis said that the "situation" was the suspension of a cable re pairmarf named Raymond Russell Russell was suspended at noon Monday Union officials and telephone company officials met Mon day afternoon to discuss Russell's suspension but apparently could not come to an agreement He said that there was no picket line around company offices "The sign carriers are merely carrying signs which announce that a union meeting is in prog he said Company Issues Statement Meanwhile the telephone company said that it was manning its switchboards and other key positions with supervisory personnel who are not members of the union In a formal statement Sanders district manager for the telephone company said: "This work stoppage is apparently the result of the suspension of two employes for violating definite instructions and procedures The suspensions are for two days In order to provide uninterrupted service to the public by avoiding work stoppages such as this the contract between the telephone company and the union provides for definite procedures for handling greviences if the union does not agree with this action The union has chosen to call an unwarranted work stoppage contrary to provisions of the contract" Sanders said telephone service would be curtailed to somoi extent if the work stoppage continued He said dial telephones would not be affected but that he anticipated some restriction in long distance service during peak load hours Sanders could not give an exact figure as to how many union members were absent from duty lie said he would have to check with department heads The company's warehouses on
