Then came prohibition and hard drinking came into its own. as did graft and crime, adding the words "racketeer," "highjacker," "muscler-In," "bootlegger." "speakeasy" to our everyday vocabulary. All In all, says Bergman, drinking and crime have increased in direct ratio to the addition of legislation regulating the distribution of liquor. Hence his argument that the fewer laws, the less durnkenness.

What few people realized, even in the days when the fight against the saloon was most bitter, according to Bergman, is that saloon keepers were doing more for the cause of temperance than the reformers and uir pi em-uera ana me prum-uian advocates. Drunkards Hurt Trade "The great majority of those engaged in the liquor business." uiuiibii.c, sin uum, iiiuiui auu business grounds. "They knew that the drunkard hurt their business. Contrary to popular belief, the man who drank until he was drunk did not spend any more money at the bar than did those who took one or two drinks a night. The drunkard merely took his week's allotment of drinks on a single night and then didn't show up for the rest of th week.

"And in many cases he never did show up again, either because he had been put out and had taken oflense, or because he had engaged in a fight or otherwise made himself undesirable. Also Infrequently caused the loss of otherpatronag in addition to his own. "So saloon keepers disliked drunkenness even more than reformers. by the State of New York prohibited the sale of liquor on Sunday in restaurants, hotels and clubs, and there only with meals. Passage of that law was followed by a noticeable increase in consumption of liquor and it marked the beginning of graft in connection with liquor distribution.

The law was enacted despite the objections of a majority of the people who opposed it as an encroachment on their liberty. The popular reaction was to drink on Sunday despite the law and to drink more than before. Saloons installed a few tables around the walls, placed a sandwich on a plate on these tables, and added the word restaurant" to their gilt signs. An ironic note in the was i that the free lunch, available every weekday was not served on Sunday. Only drinks were sold in the corner "restaurants." Birth of Graft Coincident with this practice, the policeman on the beat began exacting more than the usual free beer and liquor from the saloon keepers as token of friendliness.

Thus graft was born. Those saloons which could not pass as restaurants locked the front door, left the "family entrance" open and paid graft to local politicians. Then followed another State law prohibiting the sale of loquor in beer gardens. These were places where entire families gathered to enjoy a band concert or a variety show while sipping beer The result of this law was to increase the popularity of the saloons among men who left their wives at home and being alone among friends drank more and stronger potions than had been their custom at the beer gardens. Next came the famous Raines law which eliminated restrictions as to the qualifications of liquor dealers and permitted anyone who coma pav a yearly license fee of $800 to open a liquor dispensary In the best available corner store.

This law marked the beginning of low-type saloons and dives, as well as the notorious Raines law hotels. Like its predecessors, this law had been "sold" to the public as intended to restrict drinking. The effect was the opposite. Drinking was made easier and many profitable avenues for graft were opened. License Fee Increased The next step was to increase the fee to 1.200 a year.

Then brewers and distillers really got busy pushing the sale of their products, thus increasing drinking. In order to increase their sales, brewers would lend money for the license fee to almost any applicant. From one who for nearly years was closely associated with, or actively engaged in the business of providing refreshments to the thirsty comes the suggestion that, in the future enactment of liquor laws, legislators should take a few tips from the liquor dispenser of olden days not from the brewer or the distiller, but from the saloonkeeper and res-tauranteur. He is Carl Bergman, long a resident of Ridgewood, who now lives at 263 75th St.

He is a charter member of Bay Ridge Lodge, F. and A. 858, of the Ridge Club, the Eich-enkrans, the Brooklyn Arions, the Columbia, the Manufacturers and Dealers League and a half-score charitable and social organizations. Bergman is not among the ambitious prospective liquor dealers. He now 68 and has been retired since 1921.

Legend of Old Days The name Bergman is well known to those whose memory goes back to pre-dry days, and especially to to those who frequented the Man1 hattan financial district. For that name made up the electrically Ulu mlnated legend above one of the largest and most popular restaurants in the downtown section at 45-47-49 Liberty St. Even in the days when his profit-depended on the amount of liquor consumed in his restaurant Bergman was an advocate of temperance. His boast Is that nearly a score of men who have risen to eminence and influence in the business world today were "reformed" by his efforts when they were seriously threatened with habitual drunkenness. All the evils of the dear old wet days Brgman blame, on the bar and on the "threatening habit" it fostered; also on the graft made possible by thougtless laws which, while intended to curb drinking, succeeded only in increasing it.

His criticism of the old system also is directed at brewers and distillers. The more laws controlling drink ing of liquor the more drinking there will be. And he bases that state ment upon experience, explaining that: One of the first liquor laws passed JUNIOR They were much better qualified to undertake reforms that would bring about temperance and had undertaken the task when prohibition was enacted. Much progress had -been made in discouraging tha 'treating habit" by which it was believed incumbent upon each member of a group of men at the bar to buy one round. Groups Broken L'p "Most saloon keepers, when such groups became too large, would insist that they break up into two or three smaller groups.

Thus reducing the number of drinks sold. A group of nine, for instance, would buy enough for nine drinks apiece. The same number, divided into thres would only buy three drinks apiece and stay sober. "Another old custom which saloon keepers discontinued was that which required collectors for breweries to spend two and one-half percent of their collections at the bar, buying drinks 'for the house." This, Bergman explains, would obviate tha recurrence of pre-prohibition day abuses. In those days, he savs, wine producers here gave their product such names as "Medoc," "St.

Julien," "St. Estephe," and so forth, and marketed it under the implication that it was Imported. The sale of whisky in bottles only would eliminate the blending out and diluting.
