Abernethy, pas street, Freeland would be apparent, in failing to make certain the gas could not escape and leak into premises and in failing to make "the necessary and reasonable observations and inspections of the said line and standpipe." According to the complaint, Fiore suffered first and second degree burns of the face, both hands, scalp and arms; scars across the knuckles of both hands, discoloration of both hands, causalgia of hands and ears, sensitivity of hands and ears to cold, traumatic neurosis, and corneal burns of both eyes. The injuries prevented Fiore from working from Feb. 3, 1963, to May 20, 1963, when he returned to his part-time job as manager of the Grand Theater at a salary of approximately $1,900 per year, the complaint stated. Fiore's disability, according to the complaint, also caused him to discontinue his grocery business at 602 James street, which he had operated for 30 years.

The closing was blamed on a complete loss of business which the complaint attributed to Fiore's inability to open the store from the date of his injury. The complaint claims the prolonged closing of the store caused a spoilage in meat and meat products of $300, and that Fiore sold all stock in the store for $2,000 and gave away equipment valued at $3,500 since there was no sale. According to the complaint, the store had earned Fiore a net profit of $2,407.20 in 1962. Because of his injuries, the complaint avers, Fiore will be permanently unable to work as a butcher because of the condition of his hands and the susceptibility of his skin to cold and changes in temperatures and inability to immerse his hands in water. The complaint listed the following as some of Fiore's medical expenses to date: St.

DeCavege asks the court to order defendant to account for the rents, enjoin her from collecting any further rents and to appoint a trustee to sell the property and to divide the net proceeds equally beween the parties.
