The goods in question were tsro sets of double harness. The harness was produced and identified as those sold by Finaimore.and by their former owner as those stoien from him. Fate Draper was the first witness. He tetified that Isaac King, George Robertson and himself had arranged with Fiucimore topiythem for ail the harness ihey could steal. They went eaat of Eudora one night and stole the harness in question, carrying them in acas which Finnimore.furnished them for the purpose, and brought them to Lawrence and put them into Finnimore's coal scuttie where he had instructed them to leave them.

The witness admitted having testified on Finnimores preliminary examination differently, saying toat the harness were sold to Finnimore without his knowing they were stolen, but said he had been hired to so testify by promised to get him out of jail. Sis Vinegar testified that King told her about stealing the harness lor Finnimore and that she and King went over 10 Finnimor's for a visit on Sunday morning and she saw the harness there. Mrs Finnimore testified that the harnsss was bruught to the store and sold to her husband and he paid King $8 for it. In the afternoon Davis was called and stified that she was familiar with the parties in the case, aud was ia Fennimore's store when King aGd Draper brought the harness for sale. Fennimore gave him $8.00 for it, and that was all.

Mrs. Fennimore testified the same. She also said that Mr.Thorne never came into tna store and inquired it a harness had been brought there for sale. Mr. Thorne testified that be did go to the store a id inquire if a harness had been brought there for isle.
