TF By DICK WEST WASHINGTON (UPI) -In one of. those cases destined to become landmarks of American jurisprudence, the U.S. Court of Appeals ruled recently that a hangover is no defense in the eyes of the law. It made the decision in a case where a man had appealed his conviction for grand larceny and false pretenses on grounds that he was hung over when the offense occurred. The fact that he had been drunk the previous evening cast doubt on his intent to commit the crime, he contended. In rejecting his argument, the court 'said: "The evidence does suggest that (the defendant' 1 at the time of the crime, was suffering from a hangover. We know of no authority, however, which holds that such a condition precludes the possibility of specific intent." Possible Injustice Here we have, . in my judgment, a possible miscarriage of justice* It depends on what the court meant by "we know of no authority" upholding the defendant's conviction. Did it mean that . severa authorities had investigated the possibility that a hangover might preclude criminal intentions, and had found in the negative? Or did it simply mean that information on that point was nonexistent? If no such study has ever been made, then it seems to me that the defendant may have been denied due process of law. For if an inquiry of-that sort were undertaken, it might very well produce data in his favor. At any rate, there can be no doubt that the case underscores my own long-standing crusade for more scientific enlightenment in regard to the hangover. Calls for Instrument The^ record wil' show. Now that a question has been raised as to the" constitutional rights of hangover victims, the need for additional knowledge in this field becomes even more imperative. Consequently, I am today urging President Nixon to take the one action that would be certain to bring out all of "the facts, swiftly and without discord. In other words, I am urging him to appoint a presidential commission on hangovers. It's the way to get things done.
