in Nazi-occupied Europe by the end of the year are to be laid before a committee of leading Jewish'organizations today in New York The story reportedly confirmed by the State Department and a rsonal representative of President deals with how more than 2000000 Jews already have been slaughtered in accord' ance with a race extinction order by Adolf Hitler Before leaving for New York to address the committee this afternoon Dr Stephen Wise chairman of the World Jewish Congress and the president of the American Jewish Congress said he carried official documentary proof that has ordered the extermination of all Jews in Nazi -ruled Europe in After a consultation with State Department officials he announced they had termed authentic certain sources which revealed that approximately half Of the estimated 4000000 Jews in Nazi-occupied Europe already had been killed and that Hitler was wrathful at "failure to complete the extermination To speed the slaughter of the other half daring the remaining month before the deadline Dr Wise said the Nazis were moving some four-fifths of the Jews In Hitler-ruled European countries to Poland There he said Nasi doctors were killing them at the rate of more than 100 men an hour per by injecting air bubbles Into their "the simplest and rheapest method" they could And Dr Wise who heads the committee asserted that already the Jewish population Nov 25 Because of lack of a quorum of six Justices the Supreme Court is unable to decide the celebrated case which the Justice Department t' -rges the Aluminum Company of America w'ith violation of the Sherman anti-trust act by possessing a monopoly in the production and aale of aluminum This leaves in effect a decision of the Federal District Court at Now Yorh holding that the Justice Department had failed to prove its accusations The ruling was given by Federal District Judge FrancL Caffey the longest-trial in history lasting 8 months Ten days were required for the Judges to deliver ths oral opinion A Government attorney said today that notification had been received from the Supreme Court that it lacked the six justices re quired by law to pass upon the measure since four had declared -mselves ineligible Under this situation a quorum of six would pot be provided when the existing vacancy on the nine-man court is filled The Aluminum Company had pointed out in its brief filed with the tribunal that Justices Jackson and Murphy had been Attorneys General and Justice Reed had been Solicitor General when the case was pending in the Justice Department for an unannounced reason for passing on previous litigation affecting the aluminum company Unless some way out of the situation is arranged the rourt wil be unable to pass on the rase until one of the
