In a monarchy, tbe selfish aspirant is a courtier, and tells tbe monarch that he ban do no wrong. The most tyrannical measures of the ruler are cordially supported by tbe courtier, who expects preferment as the reward of bia servility. In such circumstances, the friends of humanity are tbe noble men who dare to stand up for the right against the'foroe of the oppressor who will not prostrate tbelr free souls in the dust, nor bow down to tbe calf which the oppressor orders them to worship. In a republican government, tbe courtier becomes a demagogue; but he is the same fawning sycophant still. He changes tbe object of his flattery, but not his owq servile nature.

He fawns on power still with tbe same base motive. Power is placed in other hands; bat it cannot elude bis watchful eye. However rapidly it may pass from one to another, his eye is fixed upon all its motions. The last possessor is his master, before whom be crouches with more than dog-Uke servility. He abased Hampden and Sydney because his master bade him do so; be now lauds them to the skies because be expects thereby to gain the favor of his new owner.

He reviles oourtiers, though a change of eiroumatanoes would find him the most cringing sycophant of them all. Tbe courtier is the demagogue transferred to a monarchy; the demagogue is the courtier removed to a republic. In short, courtier and demagogue are but two names of tbe same despicable character, and tbe demagogue who reviles tbe courtier is reviling himself. Of what earthly use is the demagogue? The cour- tier flatters tbe monarch, watches to see in what direction his wishes point, and eagerly runs forward to gratify them. Abandoned to selfishness, be cares not what results may follow, if he can only advance his own interests.

Bo tbe demagogue deals out nauseous doses of flattery to the sovereign people, watches tbe coutae of public opinion, and, when be is sure in regard to tbe direction, rushes in among the foremost, waits not to see what is right and what iswroag, but what Is popular, or supposed to be so. Like tbe oourtier, he is a coward, and dares not speak his own thoughts. He is a slave, and trembles at the frown of his master. He lsWt a man, for he has given up tbe high attributes of manhood. He lost his individuality.

He has become a mere machine. He strangles his own thoughts, annihilates his own souL He is a curse to bis country and to tbe human race. Of such things; for men they cannot be called, we have had enough. Hay Heaven hereafter inflict upon us as few of them as the just punishment of our sins will allow! But men who, like Garrett Davis, are true to their principles, who are not to be frightened from the path of duty by the clamors of either a one-headed or a many-beaded tyrant, are tbe glory and the strength of their conn-try. We care not whether they are with us or against us; for we know that truth will eventually be discovered wherever men honestly speak out their sen tlments.

The name of Garrett Davis will be bon ored when tbe names of many now successful dema gogues shall be despised or forgotten. We do not agree with Hr. Davis on all subjects. Indeed, some important questions of both principle and poll-ey, we are thoroughly opposed to bis views. If any man tell me that such conduct would operate against the judge, and that the people would condemn his oonduot, 1 answer him, that, in order to bring about this result, the people must first inquire into the transaction and know all about it. They are disposed to be just, and a flagrant outrage, clearly and palpably shown to them, arouses their virtuous indignation. Tbe people must first know enough to fix on him the oharge of a criminal design. In most cases; this is utterly impossible. No man publishes his villainy. When he is most corrupt, he strives to wear the garb of honesty.

Tbe law larnuhe, for this purpose, very convenient cloaks, wrapping in donbt and made of such plastic texture and accommodating pattern as to fit different subjects with facility. When the judge has to apply tbe law (especially in cases where the facts are complicated), it ia not difficult for him to envelope bia design in such principles, maxims, and quailed phrases as to make appearances seemly. He will strain here a little and yield there a little, giving a strict construction to one clause and a free construction of another, vamping up this precedent and trimming down that, enlarging the operation of tbe common law and narrowing tbe sense of a statute, with a show, at one time, ot inflexible adherence to tbe letter of tbe law, and, at another, of a liberal estimate of great principles of publio policy and private justice, until he shall bave satisfied msny persons of tbe rigid correctness of his legal argument and opinion and impressed others with tbe belief that, at the utmost, be bad committed an unintentional and very pardonable error of judgment. Wbat becomes now ol tbe public condemnation? There is likely to be doubt whether tbe judge Committed a mistake, much leas a crime, and tbe people oannot condemn bim. Let aoy one recur to his own impressions, when sitting in jury box and alternately yielding tbe assent of bis mind to opposite propositions, ably advocated and explained by opposing counsel.

Is it to be supposed that a judge, with bis authority and weight of reputation, would be auy leas successful to justifying to tbe public any opinion be might deliver? Moreover, Is it further to be expected, that, not only his error shall be detected, but that tbe mass ot tbe oommunity shall so plainly see it as to authorize them to believe be ia corrupt? Surely such an expectation would be absurd. The people would oftener suspect corruption than they would either know or remove it. Tbe remedy will be found in prevention, not in cure. Remove tbe temptations which are daily Inviting' tbe judge to make a corrupt use of bis authority. Let bim bsve no stake of bis own dependent on any of bis dec is ions.

Let all suitors be alike in bis eyes and none of them his masters, and then be will neither be corrupt nor suspected of corruption. But there is a class of oases in which the subserviency of tbe judge to popular opinion Is very apt to oocur. Whenever tbe publio interest is awakened, and a deep and general prejudice exists, tbe best possible constitution of tbe jodiolary department does not altogether relieve the incumbent from tbe danger of participating in tbe common sentiment, and falling into error. So fer from guarding against this danger, tbe new constitution, by means of the plan of electing tbe judge by tbe votes of tbe comma oily thus prejudiced and impassioned, brings the judge into the very whirlpool of the popular passions. If there be any truth undeniable, it is that publio opinion ought not to oootrol the courts in deciding on mens rights.

That would be to raise a power above tbe laws of tbe land, which is despotism. As public opinion is not to oontrol, we must not plaoe the judge under subjection to it, by making him tbe creature of popular elections. MADI80N. jyjr M. We have heretofore informed our readers that seve ral counties in Virginia have held meetings and de clined to respond to the call made on them by the Legislature to send delegates to the Nashville con vention. We are glad to perceive that tbe important county of Albemarle has also resolved to sot pa triotieslly and not seotionally in relation to the present agitation. A very large meeting of the citizens of that county was held In the oourt-bouse on tbe 1st instant. After tbe meeting wae organized, W. J.

Robertson, offered a preamble and resolutions which be hoped would be adopted unanimously. They were responsive to tbe call of tbe Legislature, and provided for holding a convention in the district to select delegates to the Nashville convention. CoL T. J. Randolph rose and objected to the adoption of any such resolutions as had been read.

He offered a substitute for them, in which strong grounds were taken against the proposed convention. One of tbe resolutions declared said convention to be premature and uncalled for at this time, that there exists now nOsuoh exigency In tbe tffairs of tbe nation ns to render the meeting of such a body necessary and proper, and, moreover, that its deliberations, should it convene nnder existing circumstances.
