JOHNSON CITY PRESS Wednesday November 28 1990 Page 19 cause wreck to find of fafai The Associated Press KNOXVILLE A preliminary investigation Tuesday failed to find fault with the brakes of a runaway dump truck that crashed in a parking lot and buried a 71-year-old man under tons of steaming asphalt Charles Sprankle was trying to help a Florida man with his stalled car when the dump truck crashed into the lot about 2:30 pm Monday JHe died instantly Police Officer Steve Tinder said Truck driver Terry Conner 42 Knoxville escaped injury in the wreck Authorities said Conners 1973 Ford dump truck lacked a license tag or any markings identifying its owner Conner Paving But police spokesman Foster Arnett said "We do not anticipate filing any (criminal) charges at this time against the driver of the truck "He may get a ticket for not having a proper license but he is not going to be charged with vehicular homicide or anything like that" Capt Gary Long of the Public Service Commissions Knoxville office said Conner wouldnt be cited for failing to put his companys name on the truck "Thats not a citeable offense Long said Producer freed The Associated Press MEMPHIS Record producer Chips Moman once the darling of music industry boosters in Memphis was freed on bond Tuesday after a night in jail on a contempt of court citation "I do admit I sometimes lose my temper and I apologize Moman said after Chancellor DJ Alissandratos allowed a bond of $250 Alissandratos issued the contempt citation Monday during a Dorm fire Accused led police to grave The Associated Press MADISONVnUE Two yean after Cathy Clowen disappeared Joe Shepherd led police to a shallow grave containing the 15-year-old girls body a former Monroe County deputy testified Tuesday Shepherd took authorities to the grave in the Cherokee National Forest on April 13 1978 at the urging of his father Joe Graves told a jury in Monroe County Circuit Court "We walked about a hundred yards along a branch Graves said "Joe stopped and said 'Dig here He walked right to that Richard Fisher then the dis- trict attorney general began caging and immediately unearthed pieces of red cloth resembling clothing Miss Clowen was wearing when she disappeared March 27 1976 Shepherd was taken back to jail and Dr William Bass a University of Tennessee forensic anthropologist was called in to remove the body and perform an autopsy Graves said Shepherd 37 Tellico Plains is on trial for fint-degree murder in the death of Miss Clowen one of two teen-age girls hes accused of killing Hes also scheduled to stand trial for the February 1978 slaying of 16-year-old Roxanne Woodson Tellico Plains although no date has been set for that case District Attorney General Jerry Estes has said the state will not seek the death penalty for Shepherd in the Clowen case because Tennessees death penalty had been ruled unconstitutional at the time she was killed The death penalty however will be sought in the Woodson case' he said Graves told the jury of six men and six women that he believes Shepherd who in April 1978 had -already been charged in Miss Woodsons death led them to Miss Clowen grave with plans to escape Four months after that Shepherd did flee breaking out of the Bradley County Jail Cleveland Tenn and heading for Canada where he hid fqr 10 yean until bis recapture Police arrested Shepherd on Nov 18 1988 in London Ontar-' io after a neighbor identified him from a segment on NBC-TVs Unsolved Mysteries program He was returned to the United States earlier this year Graves testified Shepherd told police he and a teen-age boy had ridden around with MissClowera "and smoked marijuana and drank on the night she disappeared That boy Billy Gentry now 28 also took the stand Tuesday testifying that the trio parked in the Twoods near Tellico Plains and TShepherd spent some time in the lack seat with Miss Clowers while Gentry waited outside When he returned to the car Gentry said Miss Clowers wad Trying and said she wanted to go jhome He said Shepherd dropped him off at his home a short time jlater and that was the last he Jaw of Miss Clowers 1 heard later that Kathy had Hieen reported missing and I went rto Joe Shepherd two weeks after 4his happened and asked him if he had seen her Gentry said "Joe told me she had gotten into a car at a truck stop south of Madisonville with several boys and went to Florida" In his opening statement defense attorney Franklin Chancey jsaid the autopsy showed Miss flowers had traces of the prescription drug sinequan in her iystem The drug is a tranquilizer hat can be deadly when mixed with alcohol Chancey said knows for sure whpt killed Cathy Clowers Chancey said Conner told police he was traveling along busy Kingston Pike when ah indicator showed the truck was losing brake pressure as he neared a major intersection with Northshore Drive "His only option was to run into the traffic at the light or turn off into the parking lot Tinder said But Long said the PSCs initial investigation "didnt find any out-of-service item any real serious-defects on the truck "As far as we have been able to determine the brakes were in adjustment he said Long Baid however that the PSC had impounded the truck and would conduct a more thorough inspection Wednesday The truck crashed into the parking lot of a bank striking three cars before dumping the asphalt and tipping over on its side One of the cars was Sprank-les gold Mercedes Another was a Cadillac rented by Miles Schla-pik Miami Sprankle was trying to help Schlapik start the Cadillac when the accident occurred "He was trying to get my hood up to help Schlapik said "I shook his hand and told him he was a fine person after night in jail hearing on a civil suit stemming from the sale of Momans 3 Alarm Studio The bond was granted during another hearing on the same suit A sheriff's deputy brought Moman to the courtroom in handcuffs for the second hearing With the bond community colleges and area vocational-technical schools is billed as a way to make higher educa- tion more accessible while saving money in the process The $15 million plan is also described as a first step in efforts to overhaul the educational system governed by the Tennessee Board of Regents The regents are expected to review the plan next month If approved it then would go to the Legislature The plan was drawn up at the irection of Gov Ned McWherter said Harry Wagner the regents executive vice president The plan was presented to West Tennessee legislators and college officials in meetings Monday In Memphis and Dyeraburg Similar meetings also are scheduled for other parts of the state Wagner said The plan calls for setting up 13 community college districts with multiple satellite campuses over the next two years Area vocational-technical schools would become branch campuses of the two-year colleges The regents system currently includes six four-year colleges three
