2 JOHNSON CITY PRESS CHRONICLE, Thursday Evening, January 28, 1982 Judge denies The weather new trial to kidnapper Today By Linda Sanders -C Bureau A motion for a new trial was denied Wednesday in Criminal Court to a Johnson City man "serving a life sentence for aggravated kidnapping. Judge Arden Hill denied the seven-point motion filed by Bobby Lynn Crum, 30, who was convicted in December of the Feb. 18, 1980, kidnapping of a Greene County woman. The woman said Crum forced her at gunpoint to go with him to Roan Mountain, where he raped her twice. She testified that she did not see the weapon, but said Crum told her he had a gun.

Crum pleaded insanity in case, but a psychologist at the Middle Tennessee Mental Health Institute said Crum had been declared competent to stand trial. Testimony indicated Crum suffers from "anti-social behavior." In the motion for a new trial, Crum maintains that during the December trial, he was under the influence of prescribed antipsychotic and tranquilizing drugs, which prevented him from assisting his attorney, Victor Vaughn, in defending his case. He also said he was unable to comprehend the nature or seriousness of the charges against him. and was unaware of the maximum sentence he could receive if found guilty of the charges. During the motion hearing, Crum said he had been taking the drugs four times a day during that period in December and "felt like I wanted to sleep." He also, said he "couldn't make out what was Crum said Wednesday he had not taken any medication Wednesday morning.

In denying the motion, Hill said. "I don't see any difference in the way he (Crum) is acting todav than at the trial." The motion also alleged: That the verdict was contrary to the weight of the evidence. That the jury failed to give full and complete consideration to all of the evidence introduced and that the verdict was motivated by passion, caprice, or prejudice. And that there should have been a directed verdict of acquittal because it was established that Crum was suffering from mental illness. Following the motion, Crum asked that he be allowed to have the same rights as other prisoners.

including the right to have writing materials, religious materials, that he not be compelled to take drugs, and that he be placed in a one-man cell due to his past history of mental illness when taken to prison. Hill said he could not grant the motion, because he did not have authority over prison rules and regulations. Crum's case will be appealed, Vaughn said. In a related case. Crum pleaded no contest to a charge of automobile larceny and was sentenced to serve three years.

The sentence 15 to run concurrently with the life sentence. In other court action, a firstdegree burglary case against David Tester was placed on the retired docket. Since he agreed to having the case placed on the retired docket, Tester waived his right to a -Deedy trial; the case can be reactivated if Tester has further problems with law enforcement agencles. Elsie Fain, 222 E. Fairview charged with selling Schedule Il drugs, pleaded guilty to simple possession of Schedule II drugs.

She was sentenced to 11 months and 29 days in the County Jail and fined $750. All but 30 davs of the sentence was suspended. It will be partly cloudy and mild; the high will be in the upper 40s. Winds will be from the southwest at 10-15 mph, turning northerly later. Tonight It will be fair and not as cold; the low will be in the upper 20s.

Carter County man sentenced to 15 years for armed robbery By Teri Hill -C Jonesboro Bureau Security was tight in Criminal Court in Jonesboro Wednesday night as a Carter County man was sentenced to 15 years in prison for armed robbery. Eddie Dean Dickson, 20, Meadow Brook Trailer Park, was found guilty of the April 23 armed robbery of the Mountaineer Package Store in Johnson City. The security during the announcement of the verdict was due to belief, on the part of Johnson City officers and county deputies, that Dickson would try to run.

He did not make any attempt to do so. Patsy Ellis, Rt. 5, an employee at the package store, testified that a man, whom she identified as Dickson, came into the store around 10:45 p.m. and told her to give him money. Miss Ellis said he pointed a gun at her face and told her he didn't want to shoot her.

She told the court she was "scared to death" and began taking the money out of the. register and gave it to Dickson, who was wearing dark glasses and a red bandana across the lower half of his face. "I threw the money to him on the other side of the She said some of the money fell to the floor and Dickson told her to come around and pick it up. After he got the money, Miss "Ellis said, he ran out the door and along Elm Street. Yancey Fernandez, a driver for Diamond Cab, testified that he received a call to pick up a man at the Jiffy Market, Myrtle and Elm streets, two blocks from the package store.

Fernandez said Dickson first told him he wanted to go to Asbury, and then changed his mind and told him to take him to Milligan. Deaths A CO BULLS GAP Robert Glen Archer, 64, Bulls Gap, died Tuesday night of an apparent heart attack Mr. Archer war as member of the Bulls Gap Baptist Church and the chairman of its Board of Deacons. He also served as the Sunday School director. He was a member and past master of the Bulls Gap Lodge No. 764 and AM, and of the Scottish Rite, Jericho Shrine Temple and the Lions' Club.

Mr. Archer was a Navy veteran. Survivors include his wife, Trula Morley Archer; one son, Robert L. Archer, Rock Spring, three sisters, Ralph Firminhac, Kent, and Mrs. Connie Steen and Mrs.

Bonnie Payne, both of Johnson City; one granddaughter. Stewart is in charge. MRS. ELSIE A. ANGEL ELIZABETHTON Mrs.

Elsie Amanda Angel, 76, 816 Virginia died Wednesday afternoon in the Carter County Memorial Hospital, following an extended illness. Mrs. Angel was a native of Carter County and a daughter of the late Bert and Julia Cable Angel. She was preceded in death by a son, Charles Frederick Angel, in 1956. Mrs.

Angel was a retired employee of the former Elizabethton Steam Laundry. She was a member of the East Side Christian Church. Survivors include her husband, Nelson Angel; three daughters, Mrs. Betty Wandell and Mrs. Sue Stout, both of Elizabethton, and Mrs.

Claude Peeks, Rogersville; one sister, Mrs. Lillian Cable, Elizabethton; 10, grandchildren; seven great-grandchildren. Tetrick, Riverside Chapel, is in charge. THE REV. W.

W. WHITT LENOIR, N.C. The Rev. W. W.

Whitt, 60, Lenoir, died at his home Monday afternoon, after a lengthy illness. He was a former resident of Erwin, Tenn. Prior to his illness, Mr. Whitt had served as the pastor of Green Rock Baptist Church. He was an Army retiree with 22 years of service.

Mr. was preceded in death, by his parents, Mr. and P.H. Whitt; one brother, Thurman H. Whitt; and one son, Paris A.

Whitt. Survivors include his wife, Cleo Byrd Whitt; four daughters, Mrs. Terry Summerlin, Lenoir, Glenda Kay and Misty Lynn Whitt, both of the home, Wanda Greer, Jacksonville, two sons, William Wade Jr. and Carmin Todd Whitt, both of the home; five sisters, Mrs. Harry Landreth, Jonesboro, Mrs.

Frank Sparks, Brunswick, Mrs. Hubert Miller, Erwin, Mrs. Maxine Jarrett, Riverdale, and Mrs. Marie Laws, Johnson City; four brothers, Alvin W. Whitt, Columbus, Ohio, Jack L.

and Robert L. Whitt, both of Blackshear, and Kenneth G. Whitt, Jonesboro; nine grandchildren. Pendry's is in charge. WAYNE DAVIS II HAMPTON Wayne Davis II, the infant son of Wayne and Brenda Lewis Davis, died Wednesday morning in Johnson City Medical Center Hospital.

Survivors, other than the parents, include the paternal grandmother, Mrs. Hazel Davis, Hampton; maternal grandparents, Mr. and Mrs. Raymond Lewis, Elizabethton; maternal greatgrandfather, P.P. Lewis, Hampton; several aunts, uncles and cousins.

Hathaway-Percy, Elizabethton, is in charge. MILDRED E. LOVE ELIZABETHTON Mildred Ethel Love, 63, Rt. 3, died Thursday morning in the Carter County Memorial Hospital, following a brief illness. A native of Carter County, she was a daughter of the late John Russell and Louie Ellis Love.

Miss Love was a former employee of the Bemberg Corp. and a member of the Borderview Christian Church. She was preceded in death by a a L. Ritchie in 1975. Survivore include two sisters, Zelma "Crickett" Love, of the home, and Mrs.

Tiney Johnson, Elizabethion, four brothers, Ellis, Clyde, ike and Howard Love, all of Elizabethton; several nieces and nephews. Memorial is in charge. JESSIE M. ELLIOTT ELIZABETHTON Marie Elliott, the infant daughter of Larry and Wynona Moore Elliott, Rt. 9, died Wednesday evening in the Johnson City Medical Center Hospital.

Survivors, other than the parents, include one sister, Regina Ellis; maternal grandparents, Mr. and Mrs. Clarence Moore, Elizabethton; paternal grandparents, Mr. and Mrs. Thurman Elliott, Mt.

Vernon, maternal greatgrandmothers, Mrs. Goldie Morris, Watauga, and Mrs. Bertha Dempsey, Elizabethton; paternal great-grandmothers, Mrs. Nellie Elliott and Mrs. Vertie Whittington, both of Roan Mountain.

Tetrick, Riverside Chapel, is in charge. Funerals Funeral services for Roy T. Webb, age 81 of 2, Jonesboro, who died Wednesday morning in the Johnson City Medical Center, will be conducted at 2. p.m. Friday from the Sulphur Springs Baptist Church, with Rev.

Albert South Jr. and Rev. Andy Greer, officiating. Burial will follow in the Sulphur Springs Cemetery. Active pallbearers will be Marvin Patton, Mar: vin Shaw, Kyle Cross, John Brinkley, Pete Jenkins and Bill Brinkley.

When asked about the red bandana, Fernandez testified that he didn't know anything about it until the preliminary hearing.

He told the court that he went back to the cab company and got a red bandana that had been found in his cab by another driver who drove his cab. Because testimony from Fernandez about the other driver's finding the bandana under the seat of Fernandez's cab was ruled hearsay, a last minute effort was started to find the other driver. The effort proved futile, and testimony continued. Karen McKay, who lived in the previously-mentioned trailer park at the time of the robbery, testified that Dickson had come to her trailer around 11:30 that night, looking for her boyfriend, and while he was there, told her he had robbed a store. Robin Green, who also lived at the trailer park at the time, told the court that sometime after the robbery, some detectives drove into the park.

She said she was talking to Dickson and his wife that night and told them there were police outside and Dickson "jumped up and said not to tell the police that he was there." Ms. Green said he then ran from the trailer. Dickson took the witness stand and told the court that he had not robbed the store. He testified that he had been waiting for his grandmother's return at her house in Asbury until at about 9:30 when he left the house walking. He said he left go to Hills' Department Store to catch a ride with Miss McKay.

Dickson testified that he drank about three beers, while he was waiting. He said he started walking home at about 10:15 and got a ride to the Jiffy Market on Elm Street, where he decided to call a cab. After he got into the cab, he said, the driver asked him if he smoked pot and asked him if he wanted some. Dickson said the two smoked five joints, two of which were his and laced with angel dust. He testified that the reason he ran from the trailer when the detectives arrived had nothing to do with the robbery.

Dickson said that Dickover had tried to shoot him, testifying that he was at a cousin's house when Dickover ran up to him, pointed a gun in his face and said, "Run now!" Dickover testified that he had not tried to shoot him and said he aimed the gun at him because Dickson had run from them for 80 long and that he might still have the gun he allegedly used in the robbery. Dickson told him that he was the "Phantom Burglar" and that he had just robbed the package store, the cab driver said. Fernandez said he took Dickson to the trailer park and Dickson gave him a $10 bill and two $5 bills for a $7.50 fare and told him to keep the change. According to his testimony, Fernandez told Johnson City officers Sgt. Bill Dickover and Sgt.
