The city council met Friday, night as a canvassing board to count the votes oast at the city election last Tuesday. The results of the count confirmed (the original report of the judges, and only a few errors were found in summing up the majorities'. After the count was made, the mem bers of the school board, councilmen and city court officials were declared duly elected, and the city clerk was authorized to issue them certificates of itheir election The following officials were declared elected with the majorities with their names: T.

Howard Gould, in her suit for divorce, gained a point yesterday. The appellate division, by a unanimous vote, sustained the appeal of her counsel from the decision of the lower court in regard to the examination of witnesses as to the alleged acts of Mrs. Gould iprior to her marriage to Howard Gould. The decision prevents the introduction of evidence in regard to the wife's alleged relations with Colonel William F. Cody (Buffalo Bill- previous to her marriage.

Mr. Gould, through his attorneys, obtained an exparte order for the examination of Helen Mar in advance of the trial It was alleged that Mrs Gould had confessed to Helen Mar to certain irregularities previous to her marriage to Mr. Gould. The order was objected to at the time by Mrs. Gould's counsel, and when granted an appeal was taken to the higher court The court finds in favor of Mrs.

Gould and reviews the case briefly. In part the decision says: "The action was commenced over eight years after the marriage and the testimony sought relates only to antenuptial. of the plaintiff, which, if established, would not constitute a defense to the action. It is true that there are in the affidavit certain allegations of fraud, but if ithey be established it would not justify the defendant in abandoning the plaintiff or maltreating her after the marriage. Transaction of Business. After the vote "had been canvassed, the council met in adjourned session to transact the business left over from the last meeting. J. K. Beatty, S.

S. Carrimgton and W. J. Frazier were apointed as a board of appraisers for condemnation of property necessary for the opening of Sixteenth and North streets. Sixteenth street is to be opened from Walnut to the railroad right of way.

North street is to be opened through on block in the Pottery addition. An ordinance to change the frontage of lots No. 20 and No. 21 in block No. 3 of Upham's South Park addition was read an passed tbe council.
