Cox Rites Thursday Tyler Courier Times WEDNESDAY, AUGUST 2, 1989 Sec. 1 Graveside services for J.J. (Jack) Cox, 7 79, Tyler, are scheduled for 10 a.m. Thursday at Cathedral in the Pines Cemetery with the Rev. Elwood Stetson officiating, under direction of Burks-Walker-Tippit Funeral Home, Tyler.

Mr. Cox died Tuesday evening at his residence after a lengthy ilness. He was born Oct. 2, 1909 in Ava, Mo. He retired in 1973 after 42 years with the Marathon Oil Company.

He was a PresbyteriJ.J. COX an. COX Survivors include his wife, Betty Kent Cox, Tyler; a stepson, Wayne Kent, Tyler; a daughter, Pam Coward, Tyler; two sisters, Marie Cox, Henderson, and Frances Webb, Mesquite; six grandchildren and great Honorary pallbearers are Bobby Gormon, Danny Brown, Tim Lowdes, Jimmy Vinson and Jim Williams. Mrs. Balch Rites Friday Graveside services for Mrs. Henrietta Jean Roach Balch, 59, Tyler, are scheduled for 1 p.m. Friday at the Lindale City Cemetery with the Rev. Glen Wierick officiating, under direction of Lloyd James Funeral Home, Tyler.

Mrs. Balch died Tuesday in a Tyler hospital after a brief illness. She was born March 17, 1930 in Waco. She grew up in Tyler and returned here to live three years ago. She was a housewife and member of First Baptist Church.

She was the former wife of Capt. Allen H. Balch, U.S. Navy retired. She was preceded in death by her father, Evan A.

Roach, and her stepmother, Pauline Fleming Roach, both of Tyler, and her mother, Lillian Starr Roach, Waco. Survivors include one son, Allen Henry Balch, Houston; four daughters, Paulanne Balch, Boston, Deborah LaCivita, Old Greenwich and Patricia Tracy, Manassas, and Karen Pittman, Ruston, and six grandchildren. Memorials may be made to Hospice of East Texas or the American Cancer Society. The family will recieve friends 7- 8:30 p.m. Thursday at the funeral home.

Couple Captured Five Years After Smith County Escape Two fugitives who had escaped Smith County Jail and remained at large for nearly five years were returned to Tyler Tuesday after waiving extradition from Arkansas on a variety of charges discovered during an Internal Revenue Service investigation. Clyde Malone, 54, and his wife Edna Malone, 52, were booked into Smith County Jail at 5 p.m. after being brought back to Texas from Arkadelphia, where they were apprehended last week, said Smith County Sheriff J.B. Smith. Precinct 1 Justice of the Peace Mrs.

Leon Hicks set a $100,000 bond for felony escape against Malone and a $50,000 bond against his wife for a previous aggravated sexual assault charge, a jail spokesman said. Smith County District Attorney Skeen said Tuesday that other charges are possible. Mike Jones, chief deputy of Clark County Sheriff's Department in Arkadelphia, said the couple was arrested last Thursday after returning to that city from a truck-driving trip. He said the arrests were made after an investigation that arose from a report by a Dallas man. "We got a call from a gentleman in Texas saying someone was possibly using his name and it came back on his taxes and (the IRS) was going to sue him for a couple thousand dollars," Jones said.

He said the caller told investigators "that this individual down here (in Arkadelphia) was probably the culprit, and so we called up and found that his last employment was at a small place in our town as a truck driver. When he came back into town we did some investigating and found that he was wanted under his given name and we snatched him up. Both Malones had been charged in the sexual assault of a 13-yearold Smith County girl when the escape at the old Smith County Jail at Smith County Courthouse occurred Aug. 25, 1984, Smith said. Skeen said Mrs.

Malone had been freed from jail after posting $50,000 bond when the escape of her husband occurred. Malone had been held on a blue warrant from Texas Department of Corrections for parole violation, Skeen said. At the time, he was not eligible for release because of previous charges of burglary, felony theft, forgery and fraud. Smith said the escape occurred when Mrs. Malone allegedly came to the jail disguised in a blonde wig and dark glasses.

County Sheriff Frank Brunt had said the escape occurred when Malone who had been working kitchen detail as a trusty was talking with his disguised wife, who had been allowed into the jail even though it was not during visitation hours. Brunt said at the time that Malone should have been assigned trusty status because of his criminal record and the charge for which he was awaiting trial. Smith said he learned since the arrest that Malone "was using his brother-in-law's name in Dallas and (Mrs. Malone) was using her dead sister's name. IRS clicked on this in Dallas because somebody was still paying dual Social Security on the same card," he said.

Smith said the couple had been working for an Arkansas trucking firm at least four years. Jones said the IRS showed that Mrs. Malone's brother "had two incomes and neither (her brother nor her husband) knew what the other one was making and when they combined (the incomes) they probably thought he was trying to not report his income." Skeen said the couple was arrested on April 30, 1984, on a charge of aggravated sexual assault of a child stemming from the alleged April 20 assault of the daughter of friends of the Malones. According to the report filed with the sheriff's department on April 23, 1984, the girl was assaulted while riding back from a trip to buy beer in Kilgore. Skeen said Mrs.
