Whitakcr, 47, of Pottsvillc, has been -released on $10,000 bail pending grand jury action following a hearing on a charge of interstate transmission of wagering lnforma-' lion. Whitakcr, owner of Matt's Cigar Store in Tottsville and president of Mattson Realty which operates the Davis Hotel in Potts-ville, was arrested by the FBI Thursday. No testimony was given at the hearing before U.

S. Commissioner G. Fred Steinrock. However the FBI presented a five-page affidavit outlining its case. In June 1960, Whitakcr was arrested by state police and charged with 11 counts of gambling violations.

However, the Schuylkill County grand jury returned no indictments. This month state police rearrested him on the same 11 counts. He is free on bail awaiting court action. In 1939, Whitakcr pleaded guilty to receiving stolen goods. He was placed on probation after being sentenced to five years in the Schuylkill County prison.

Authorize Johnston To Amend Petition IIARRISBURG (AP) Harvey F. Johnston, a real estate broker from McKees Rocks, may still get his chance to run against Richardson Dilworth for the Democratic nomination for governor on May 15. Dauphin County Court authorized Johnston Thursday to amend his nominating petitions to make them acceptable to the State Elections Bureau. The Elections Bureau rejected the petitions last Friday because Johnston listed the postal addresses of 125 signers instead of municipal addresses, as required by law. He was given six days to correct the mistake, and present the amended petitions to the Elections Bureau.

If they are accepted, he will join Charles J. Schmitt of Erie County in opposing Dilworth, the Democratic organization-backed candidate for the party's gubernatorial nomination. Johnston said his purpose in running is to give voters a chance to express their objections to the organization candidate. Schmitt is running on a platform legalizing gambling and lotteries. Prutzman, superintendent of Carbon County schools for the last 32 years, announced yesterday he is a candidate for re-election to the post.

Election of the superintendent is scheduled to take place April 10 at a meeting of county school house, Jim Thorpe. He had been ill since Christmas Day 1961 and was previously patient at St. Joseph Hospital, this city. Btrn in Conyngham, he resided in that area his entire life, lie was a farmer until his retirement' three years ago. The deceased was, a member of the United Church of Christ, Conyngham. His wife, Iona, died in 1960.

Surviving are a (laughter, Mrs. Sterling Evans, Conyngham; a son, LeRoy, Candor, N. and six grandchildren. The funeral will be held Monday at 10:30 a. m.
