Funeral services for Elbert Robinson, 80, of Pittsburg are set for 2 p.m. Thursday in Holly Springs Baptist Church with the Rev. Paul Clark officiating. Burial will be in Lafayette Cemetery under direction of Erman Smith Funeral Home.

Mr. Robinson died Tuesday night at a Pittsburg hospital after a long illness. He was an Upshur County native, a World War I veteran and a member of Holly Springs Baptist Church. He was a retired farmer. Survivors include his wife, Mrs.

Velma Robinson of two sons, Verlon Robinson of Reidsville, N.C., and Carroll Robinson of Pittsburg; two daughters, Mrs. Neal Seale of Pittsburg and Mrs. Inez Peters of Dallas; one brother, Low Robinson of Marshall; nine grandchildren; and four -grandchildren. Horton Green MABANK (Spl.) Funeral services for Horton Green, 52, Mabank, are scheduled for 10 a.m. Thursday in Eubank Funeral Home chapel with the Rev.

James Jacobs officiating. Masonic graveside rites are scheduled for 2 p.m. in Tidwell Cemetery near Greenville. Mr. Green died Tuesday in Mabank after a brief illness.

He was born in Hunt County and lived in Mabank one year. He was a former Houston resident and was employed by Business Machines. Later, he was employed in Mabank Greens Super Save. He was a member of Northway Baptist Church in Dallas. Survivors include a son, Phil Green of Mabank; a daughter, Mrs.

Carla Green of Houston; a brother, Guy Green of Mabank; and two sisters, Mrs. Dorothy Smith of Granbury and Mrs. Veta Hamm of Dallas. Pallbearers include Roger Barnett, Dale Boehme, Tony Everett, Phil Green, Ken Green and Jerry McDonald. Mrs.

Harris ARP services for Mrs. Ida Bell Harris, 84, Arp, are scheduled for 2 p.m. Friday in Pearson Funeral Home chapel in Overton with the Rev. Jim Atkins officiating. Burial will be in Overton Cemetery.

Mrs. Harris died Wednesday morning in an Overton nursing home after a short illness. She was born Jan. 29, 1893, in West Virginia, moving to East. Texas from Crane.

Survivors include five sons, Robert P. Harris of Overton, Wilbert H. Harris of Temple, Raymond W. Harris of Arp, Lewis C. Harris of Baytown and Don Harris of Kilgore; three daughters, Mrs.

Mary Spangler of Houston, Mrs. Maxine Bynum of Henderson and Mrs. Lucille Worley of Overton; two brothers, Jim Givens of Middleburn, and Herb Givens of Ohio; a sister, Mrs. Audry Smith; 35 grandchildren; 41 great-grandchildren; and three greatgreat-grandchildren. Grandsons will serve as pallbearers.

Henry H. Pool GLADEWATER Graveside services for Henry H. Pool, 64, Gladewater, are scheduled at 2 p.m. Thursday at Gladewater Memorial Park with Rev. Leon Grissom officiating.

Mr. Pool died Wednesday morning in a Gladewater Hospital after a short illness. Local arrangements are under direction of Malcolm Stone Funeral Home. Mr. Pool was a Rusk County native and resided in Gladewater the last 3 years.

He was a retired employe of El Paso Natural Gas a Mason and member of Scottish Rites and Shrine Temple in El Paso, Survivors include his wife, Phyllis Pool of Gladewater, two sons, Tom Pool of Odessa and Robert Pool of Lake Jackson, his mother, Mrs. Maude Pool of Carthage, one brother, Lewis Pool of Carthage, one sister, Mary Miller of Houston and one grandchild. He was a native of Houston, but resided in the Gladewater area for several years. Mr. Parker was a self-employed rancher and member of the Episcopal Church. Survivors include his wife, Mrs. Vivian Parker of Gladewater, three.

Mr. Jocoy died Tuesday afternoon in a Van nursing home after a long illness. He was born in Missouri and lived in Van four years. He was a retired drilling contractor and member of Van Assembly of God Church. Survivors include his wife, Mrs.

Mr. Allen died Tuesday in a Tyler hospital after a short illness. He was retired sales manager for Schnley, an Episcopalian and a native of New York State. Survivors include his wife, Mrs. Mary K.

Allen of Emerald Bay one son, Jeffrey B. Allen of New York City; one daughter, Mrs. Katie Finn of Tyler; one sister, Mrs. W.L. Collins of Inglewood, Fla.

Mr. DuPree died Tuesday afternoon in a Tyler hospital after a long illness. He was a native of Dallas, a Bullard High School student and a member of Bullard Church of Christ. Survivors include his parents, Mr. and Mrs.

The infant died Tuesday night in a Tyler hospital. Louis Baptist Church where he served as deacon, Sunday School teacher and member of the adult choir. He was a member of the National Association for the Advancement. of Colored People and worked at Broadway Furniture Co. Mr. Jeffery attended St.

R.B. Thurmon Rites Slated Funeral services for Roger Bruce Thurmon, 26, Dallas, relative of two Tylerites, are scheduled for 2 p.m. Friday in Restland Funeral Home's Wildwood Chapel in Dallas with the Rev. Ken Hay officiating. Burial will be in Restland Memorial Park in Dallas.

Mr. Thurmon died Tuesday in Dallas after a sudden illness. Pearl MacDonald Rogers of Tyler. C.M. Garrett Rites Slated Graveside services for Claude Manning Garrett, 93, Austin, formerly of Tyler, are scheduled for 2 p.m. Friday in Pleasant Retreat Cemetery with the Rev. Don Emmittee officiating.

Local arrangements are under direction of Lloyd James Funeral Home. Mr. Garrett died Wednesday in Austin after a lengthy illness. He was a native of Como and lived in Austin for eight years. He was a Baptist.

Survivors include a daughter, Mrs. Dorris Garrett Conway of Austin; four grandsons; and eight great-grandchildren. Mt. McKinley is the largest, with an elevation of 20,320 feet. Black Activist Ordered Spend 17 Years In Prison AUSTIN, Tex. (UPI) The Texas Court of Criminal Appeals Wednesday ordered black activist Lee Otis Johnson to spend 17 years in prison on a burglary conviction. Johnson was convicted of burglarizing the Houston home of Rivest Lockett on Sept.

19, 1974, while Lockett was at a barber shop. Two pistols, three watches, a diamond ring, meat and other items were taken. A neighbor of Lockett's observed two men entering the home, followed them and wrote the license number of their car. Johnson was arrested the next day driving a car whose license plate matched that of the burglar. Johnson appealed the conviction on the grounds his attorney was ineffective, and the court erred by refusing to permit him to act as co-attorney, in admitting an involuntary confession and by admitting into evidence a pistol seized from his car without a search warrant.

Johnson complained his attorney failed to call several witnesses, including family members. The appeals court overruled Johnson's complaint, contending the attorney might have found the witnesses' testimony would not have benefited his client. "An attorney must appraise a case and do the best he can with the facts of the case, and the fact that other counsel might have tried the case different does not show inadequate representation," the appeals court said. "It must be remembered that the constitutional right to counsel, whether counsel be appointed or retained, does not mean errorless counsel, and counsel is not to be judged ineffective by hindsight." The appeals court also ruled a defendant does have a right to represent himself "but he does not have a constitutional right to hybrid representation or to act as co-counsel." The appellate court said witnesses to Johnson's written confession, including a newspaper reporter, saw no evidence of any abuse or mistreatment of Johnson. conclude from the totality of the circumstances that the confession was freely and voluntarily given by appellant after he had been fully apprised of his constitutional rights and had affirmatively waived them," the appeals court said.

HEW 'Defied' Education "continues to administer segregated schools for the deaf and blind" and cited allegations of similar situations in Virginia. It said the Department of Health, Education and Welfare surveyed 1,507 vocational schools under the original court order and found "apparent Title VI noncompliance by at least 67 schools." These schools are in Alabama, Arkansas, California, Colorado, Illinois, Indiana, Kentucky, Louisiana, Maryland, Michigan, Minnesota, Mississippi, Missouri, Nebraska, New Jersey, New York, North Carolina, Ohio, Pennsylvania, South Carolina, South Dakota, Tennessee, Texas and West Virginia, according to attorneys for the legal firm Rauh, Silard and Lichtman. ETex Teen Arrested In Arizona HOLBROOK, Ariz. (UPI) A Texas teen-ager was held by juvenile authorities Wednesday following a high-speed chase with Arizona Department of Public Safety officers. Authorities said the 16-yearold of Ben Wheeler, was arrested near Cholla Lake Tuesday after an officer fired a shotgun blast at his car and it crashed through a guardrail on Interstate 40.

No one was injured. He was charged with possession of a stolen vehicle, flight from pursuing officers reckless driving and driving without a license. The chase began after Holbrook police advised DPS that a man had defrauded a service station. Officers spotted a vehicle matching the suspect's on Interstate 40 west of Holbrook. They chased the car at speeds up to 100 miles per hour into Winslow and back toward Holbrook.

Officers said the teen was driving a car listed as stolen in Cleburne, Tex. The appeals court said arresting officers knew that pistols had been taken in the burglary and circumstances warranted the search of the car for the safety of the officers. Judge W.A. Phillips dissented, contending Johnson should have been allowed to serve as his own co- counsel. In other cases the appeals court: Upheld the capital murder conviction and death penalty given Edward Lincoln King of Dallas man in the 1974 shooting death of police officer Leslie G.

Lane. The appeals court overruled King's contentions that the trial court erred by failing to instruct the jury that evidence of the other crimes committed the day of the murder should be limited to the issue of his identity. Ordered a new trial for Leslie Rogers of El Paso, sentenced to 10 years in prison for robbery, because the jury foreman discussed an armed robbery he had witnessed. Ordered a new trial for Antonio DeLao of San Antonio, sentenced to seven years in prison for heroin possession, because arresting officers illegally seized the evidence, a balloon of heroin. Blow, son of Mr. and Mrs. J.B. Blow, 3607 Brazos, Tyler, recently completed recruit training at the Marine Corps Recruit Depot in San Diego, Calif. PFC Blow, currently serving as a recruiter assistant, will attend Helicopter Mechanic School in Memphis, and will later be assigned to the Marine Corps Air Station at Cherry Point, N.C.

He is a John Tyler High School graduate. Storms Spark Warnings By The Associated Press Heavy thunderstorms, some of them severe, moved into the middle coastal plains to Corpus Christi area Wednesday sparking flash flood watches and tornado warnings. A water spout was reported in Aransas Bay and several funnel clouds were sighted. Tornado warnings were issued for several counties around Corpus Christi and marine warnings were posted for the bay area. One thunderstorm dumped one inch of rain at the Corpus Christi International Airport in 15 minutes.

Thunderstorms and rainshowers were scattered from North Central Texas to the Middle Gulf Coast at midmor4 ning. Rain fell over all but the eastern portion of the state i in the 24 hours ending at noon. Nearly four and a half inches fell in an area 28 miles westsouthwest of Kerrville and almost two inches were reported at Alpine along with golf ballsized hail. Temperatures at noon ranged from the 50s in the Panhandle and mountains of Southwest Texas to the 70s along the coastal plains. Suit Says Order WASHINGTON (UPI) The government for four years "has contemptuously defied" a court order to desegregate vocational and special purpose schools for deaf, blind and other handicapped children, a suit filed in U.S.

District Court charged Wednesday. In one of the first civil rights suits filed against the Carter administration, attorneys for the NAACP Legal Defense Fund asked that the Department of Health, Education and Welfare be forced to carry out a 1973 order. "Only further intervention by this court can breathe life into Title VI with respect to schools for the deaf, blind and other handicapped children," the suit said. Title VI of the 1964 Civil Rights Act prohibits schools and other subsidized institutions from discriminating on the basis of race or national origin. The suit alleged that the Louisiana state Department of POLICE TRAINEE Marine Pvt.

The John Tyler High School graduate is presently attending military police Veteran Pilot Eases Crippled Plane Down TAMPA, Fla. (UF'I) The veteran pilot of an Eastern Airlines Miami-to-New York jet gently eased his crippled aircraft down on a foamed runway at Tampa Wednesday after ordering passengers to bury their heads in pillows as a precautionary measure. "It was a normal landing," said Dr. Joseph Davis of Miami, one of the nine passengers and six crewmen aboard. "In fact, it was a better landing than going into Baltimore Hundreds of spectators lined a nearby roadway to watch the emergency landing, and a cheer went up when the captain, George Lacey, 51, a pilot of 35 years, finally braked the Amtrak Hiking Fares CHICAGO (UPI) Anntrak has announced it is increasing passenger fares throughout the country to keep up with inflation and offset high resulting from the extremely cold weather of last winter.

The company said the average increase is 3 per cert but on some routes as high as 13 per cent. A surcharge of 25 cents to $1 will also be added to the price of each ticket. The increases go into effect June 1. The last nationwide Amtrak increase was on June 15 last year. A surcharge of 25 cents will be added to fares up to 50 cents for fares of $6.75 to $15; and $1 for fares above $15.

A flat 3 per cent increase will g0 into effect on trains from Chicago to Detroit; Port Huron, St. Louis; Quincy, Dubuque, Houston; Los Angeles; San Francisco; and Milwaukee. Some other increases on Chicago trains are from $8.50 to $9.50 to Champaign-Urbana; $51 to $54 to New York; $21 to $23.50 to Cleveland; $65 to $68 to Denver; $14.50 to $16.50 to Toledo; and $31.50 to $33.50 to Pittsburgh. jet to a halt in front of the Tampa International terminal. The Eastern flight, No. 152, was to have made an intermediate stop at Orlando, but Lancey noticed a problem with his right landing gear when he began preparing for the landing. After making a low level pass so control tower personnel in Orlando could check the problem, the flight was diverted, and crews from nearby MacDill Air Force base foamed down a runway at Tampa International. Lacey made another low level pass for air controllers at Tampa and then circled the area for about an hour, before bringing the plane in. He touched down softly and balanced the plane on its nose gear as he gradually slowed the plane before putting the weight on the main gear.

A rooster tail of foam sprayed out behind. The malfunctioning right landing gear was slightly canted and when the plane landed the upper portion of the gear was jammed through the wing and ripped a three-foot gash in the fuselage. Officials said the original problem arose when a retract cylinder on the landing gear popped off on takeoff from Miami.
