Anderson Mercantile company a judgment against Fred Harrington The judgment remained unsatisfied during all of these years and somethin? over a year ago Anderson levied an execution on an automobile belonging to Harrington agd undertook to- sell the same to satis fy the judgment Harrington objected to the levy and sale on the ground' that more than ten years had passed since the judgment was obtained and that under the law' the issuance of the execution anl levying on the automobile was illegal He therefore sought to enjoin Anderson from proceeding to sell the automobile by a suit in the District Court The case was tried before Judge Neil Graham and it was held by Judge Graham that it was proper to issue thl execution and that the levy was a legal one From that decision Harrington appealed to the Supreme court and the case was remanded ythe Supreme court to the Court of Appeals for decision The various contention of Harrington and Anderson were thoroughly presented in the briefs of -their respective attorneys to the highter court and on Tuesday of this week' the Court of Appeals handed dowm a decision affirming the district court and holding the procedure i issuing the execution and levying on the automobile of Harrington to be legal This means that Anderson will obtain the amount of his judgment with interest during all of the years past since the judgment was rendered 'Many similar cases hinge on the decision of this case and the opinion of the Court of Appeals has been awaited with great deal of interest because in the numerous ot' er in-stancse the same
