Standford Ky is up again in another shape It has been to the supreme court sent baeje and was going ahead when Judge Barr United Mates judge at Louisville appointed Gen Echo receiver who now holds it In the meantime the case goes on here as usual The Mississippi Valley construction company the New York Metropolitan trust company It Wilson Huntington and others are now parries Sumnpr county wants iier receiver Holmes Cummins made a motion to transfer the case to Judge court at Nashville which was overruled by Chancellor Seay and the original case will proceed A Parting Tribute Special Dispatch to The Appeal-Avalanche Jackson Miss June 4 This evening the ladies of the monument association presented Mrs Margaret Davis Hays with a magnificent tea service at the mansion where she had been entertained The presentation was made by Gov Robert Lowry in a brief and appropriate address and Mrs liays responded in a few words expressive of her heartfelt gratitude and appreciation After the presentation Mrs Hays and family took the evening train and went nortli on a visit to her mother Mrs Jtllerson Dais in New Y'ork they were interrupted by the departure of the steamship and the responsible parties will if they appear also oe called upon to answer the additional charge of contempt of court in running away while under injunction Secretary Tracy gave the Associated Press reporter tonight the chaintof circumstances that had led up to the peaceful surrender to the United States of the Itaia today The secretary said the desire for a surrender came from the leaders of the insurgent party at Iquique Shortly after the vessel had illegally escaped from the custody of the marshal at San Diego the government was informed by these lenders that they disapproved" tho action of been investigating the accounts of ex-City Treasurer Bardsley was transmitted to city councils this afternoon by Mayor Stuart The work of the accountants has embraced the ac-connts of both the city and the state but the report only deals with the former as the investigation into the condition of the state funds has not progressed far enough to be made public yet The report is an ex: tremely voluminous one and gives in detail Mr accounts with the various banks Although the work of tho experts lias been kept a secret still enough of it was made public at tho hearing of Bardsley last week to foreshadow the report made today The report shows that on May 21 according to the books of the city office there ncs on hand $323170085 belonging to the city Of this amount the books of the city treasurer shows that there was on deposit in the Keystone bank $437- 55432 This sum is claimed by Receiver Yardley and Bank Examiner Drew to be wrong and that the tank books show the actual deposit to have been 03930919 Whether Bardsley can bo held liable by the city for this money is a disputed question many claiming that the city has no vested right in It The report states that for the years 1889 1890 and 1891 inclusive Beardsley collected taxes for the state amounting to $4422887 and that the same was duly deposited as required In conclusion the report says: fur ther report that an investigation is now in progress which will reveal the disposition made by John Bardsley of the state funds by him received the particulars of which will be embodied in a report at the earliest Magallnnese was attacked by the government torpedo cruisers Aldea Comiell and Lynch In that engagement which has already been described the Magullanese succeeded in driving off the three government vessels and after a sharp fight the government cruisers retired to Valparaiso and the Magullanese after receiving ammunition from the insurgent supply ship decided to steam at once to Valparaiso and at a tho three government vessels before they could bo repaired The Magallanese under the cover of darkness steamed lip alongside the Aldea and fired a broadside which completely riddled the torpedo boat dismounted nearly all of herrupid-firinggnns and killed at wounded fully half her crew The Magallanese steamed quickly for the Lynch but the crew of the latter were alert They returned the Magallanese fire and attempted to launch a torpedo but failed The Condell had steamed outside the Magallanese and begin firing subjecting tho latter to the-fire from both government ships killing and wounding 49 of the crew The latter under cover of the smoke began to move astern and before tiie fact was discovered tho two government ships were pouring broadsides into each other 'lhe trick was not discovered until the Magailense had steamed across the stern of the Condell and had poured in a broadside which nearly destroyed the latter In the meantime the forts could not fire owing to the fear pf hitting the government ships When the Magallanese began to steam out of tho harbor the forts opened their fire But one shell struck the rebel cruiser which tore a big hole in her deck and dismounted her pivot gun She then proceeded to Caluer Over 100 men were killed in tho engagement fully one-liaif of whom were on board the Magallanese The Condell had to run on the beach to prevent creditors The company occupies five largo stores and does a wholesale business in dry goods notions shoes hats carpets and millinery and a retail business in dry goods carpets shoes furnishing goods and drugs The paid-up capital stock is $250000 The total liabilities are $164346 the purchase accounts being $254330 bills payable $157000 and mortgages payable $70000 The assets are very largely in excess of the liabilities amounting to $718743 the larger items being as follows: Wholesale accounts $105267 retail accounts $15852: bills receivable $36008 real estate $133303 merchandise "$280 244 The firm assigned to the Nashville trust company and will continue business The assignment was made because of inability to negotiate loans They did a million dollar business last year and intended of Canton Mr- A Casset to make a beautiful and costly floral design which they intended tofiresent to Miss Winnie Davis the daughter of the confederacy but in the absence of Miss Davisthe company under command of CnpLPercy Moore with LieutsII Ware and Hopson marched down from the capitol to the mansion at 4 yesterday evening and presented the gift to Miss sister Mrs Margaret Davis liays of Colorado The company numbering 20 men inline were drawn up in front of the mansion where Mrs Hays was a guest Mrs Hays and the ladies of the mansion came out and his excellency Gov JM Stone iu behalf Dispatch to 1 he Appeal-Avalanche Nasuvlle Tenn June 4 A decision in the first case brought under the ami-trust law which was passed by the last congress was filed here today by United States District Judge Key in tbe case of the United States vs tbe Jeliico Mountain coal and coke company and others This was a petition filed by United States District Attorney ltuhm to enjoin the Nashville coal exchange from operating under its agreement All of the Nashville coal dealers entered into an agreement with certain Kentucky and Tennessee mino owners for tho declared purpose of establishing and maintaining the prices of coal The dealers obligated themselves to buy from no miner outside of tho exchange while the mine owners agreed not to sell to dealers who were not members Under this
