Emmons has been sailing Harry Fayne Whitney's fiO-footer Barbara in the races of that class during the past cummer and has had much previous yacht racing experience as owner nnd nkipper of the -old sloop 'Avenger. That there will be a second syndicate, largely if not wholly composed of New York Yacht dab members, to back a second candidate for cup defense honors, is practically certain. Thaw from Colebrook, N. to New Yorfc state were signed today by acting Governor Glynn. Sheriff Hornbeck left for Concord to present the papers to Governor Thaw Is charged with being a fugi tlve from justice and among the pa per are the affidavits of various officials and residents of Dutchess county reciting Thaw's commitment and escape from the Matteawan state hospital, his flight into Canada and his arrest in New Hampshire. In his affidavit District Attorney Con ger says that in his opinion the ends of justice require that Thaw be brought to New York for trial at public expense and that he-Is willing that such expense be borne by the county of Dutchess. He says he believes he has sufficient evidence to convict Thaw on the charge of conspiracy.

No Indictment against Thaw has been found, the district attorney explains, because no grand jpry convened from the date of Thaw's escape until September- 8. The grand Jury is now In session but Mr. Conger says -Mrs. Harry Toronto, state it will not make a report of its find- womans champion, will meet Miss ings for at least two weeks.
