Newton Vickers of Sliawnee County District Court denied today a defense motion I hat next week's trial of Mrs. Milda Sandstrom be divided inlo two parts—one to determine her mental state and another to determine her guilt or innocence. She is accused of first degree murder in the May 3 • shooting death of her estranged husband, Thad M. Sandstrom, vice president for broadcasting of Stauffer Communications Inc. Her trial is scheduled to open next Monday, but jury selection is expected to take up most of the first week, before testimony begins. Sandstrom was found in the bedroom of the couple's home in a fashionable section of northwest Tupeka in the early morning hours. He had been shot Iwice in the head with a pistol which was recovered at the scene. Mrs. Sandstrom was found beside him, apparently unconscious from a large dose of some type of pills. She was hospitalized for two days, then arrested by sheriff's deputies in the hospital and jailed. She later was released on $75,000 surety bond and has been free since that lime. Mrs. Sandstrom has undergone psychiatric testing both for her defense and for the stale. Her attorney, Robert D. Hecht of Topeka, had moved for (wo trials—once to determine her menial state on the day of the slaying of Sandstrom and another to determine her guilt or innocence if she was found to be mentally competent. Hecht argued that the stale's evidence could prejudice a jury regarding her mental capacity at Ihe time of Sandslrom's death. However, Mark Bennett Jr., special prosecutor in the case, said state law makes no provision for such a two-part trial, arid noted a 1972 state Supreme Court decision held that such separated trials are not required under due process in Kansas. Otherwise, Vickers granted Hecht's motion for $3,300 more in state funds for additional psyehialric examinations, investigative services and travel money for witnesses. However, Vickers said Mrs. Sandstrom would have to repay the money if her in- digency status changes later. Vickers also set Nov. 17 as Ihe date the prosecution and defense will exchange their psychiatric reports on Mrs. Sandstrom, but he denied a defense motion to delete certain portions of the psychiatric reports which might be self-incriminating. The slate won't be able to use those, anyway, unless Mrs. Sandstrom takes the stand in her own defense and refutes information in the reports.
