9. Zoning litigation looms as the result of estabiisn-ment of a business in a Brentwood residential district, although Build ing Inspector Milo Word en refused Thomas Newton, of Babylon, a per mit to open a feed store on Suffolk' ave. Newton, it Is charged, has continued with his plans and has merchandise in the windows. The town board has author ized Inspector Worden to take whatever legal steps might be necessary to enforce the law, At an earlier meeting, Newton explained to the board that the building was originally erected as a business place prior to the enact ment of zoning regulations. He said he purchased the property recently in the belief that he could locate his business there.

A legal opnlon obtained recently. however, maintained that regard-1 Cool less1 of the purpose of the building when constructed it had never been occupied as a place of business and the builder's intention had never been translated into action. For that reason the zoning law would have to be obeyed, the attorneys contended. Mrs. W.

Mrs.Sally Flay, 96, of 1 Seaman the Bronx, was found dead In the home of Mrs. Catherine Mer- mal, of 22K Cornaga Far Rockaway, whom she was visiting. Tuesday morning. a Ambulance Surgeon Chrlstman of St, Joseph's Hospital pro nounced the woman dead on ar rival. Death was attributed to heart disease.

It came io light that the home of his son, Carroll M. Swexey, on Roe had been broken Into and ransacked. The younger Mr. Swexey is a broker in Manhattan and with his wife and children had been staying for a time at West Meadow The son's house it distant from other' homes, and several large trees partly close It from view of the street The thieves first tried to force open a window, then cut the screen around a front door and finally cut out a piece of glass in a rear window and entered in. that manner.

They apparently in search of money. So far nothing has been found to be missing. The entire house-was ransacked but the thieves were fairly ordorly in their search of the place. Murray Kay, who was chairman of the City Manager Plan committee, said it would be a mistake not to pay a good salary for the position. A fair salary, he said, would attract men of high calibre and good moral character while a low salary would put in office men who might turn out to be not quite honest. Oscar Igstaedter said a salary of $10,000 would mean an increase of $1.33 a year on the -average tax bill.

There was no opposition to the 910,000 salary while the question waa being discussed. At the close of the discussion, Mayor Frank Frankel asked the heads of civic associations if they did not believe a salary of 97,000 would be adequate in view of the city's financial condition. He said the Mayor of Glen Cove receives only 6,000. including his salary as a County Supervisor. All organization heads insisted they felt $10,000 was the right figure, i In support of the $7,600 plan, Mr.

Frankel said 4 -could be-in-creased any time the taxpayers be-. lleved the incumbent deserved more money. Several taxpayers spoke In favor of the lower salary, suggesting the salary be fixed at $7,600, and a referendum be held next year on the question of raising it Councilman Waldron spoke in favor of the larger salary. "This is the first time the taxpayers of the city have fought to pay out money," he said. "They always have fought to save it and to reduce salaries.

If the taxpayers want to pay $10,000, the council should fix the salary at that sum, especially as all organizations represented here haveasked that it be put at that amount. No one 'has spoken against it, and I believe their request should be granted." Councilman Hoey said only 909 of the 9,800 taxpayers in the city were present, and on behalf of the remaining 9,600 he intended to vote for the lower figure, particularly in the interest of the 3,000 who have paid their taxes. Supervisor Knob said the taxpayers' organizations had given a unanimous expression of opinion and he could not see how the council could do otherwise than respect their wishes. Councilman Smith said he did not believe the $2,600 difference in salary would make any change in the administration of the government to a -man who had the interests of the city at heart. When Mayor Frankel called for a vote on the salary Councilman Waldron said: "When I first spoke on this subject there was not an objection to a salary of $10,000.

Since then, some of the bashful women present have expressed their opinion, so I will change my mind and vote-for the $7,600 salary."
