Many of the 50 jobs would be transfers from Seattle and other BNSF facilities, he says, a claim disputed by railroad officials. Kootenai County officials should not use the EWU report as a basis for their decision on the depot bid, Power warned on Tuesday. They did what they were asked to do, which is provide some information to strengthen BNs proposal, he said.

"Thats useful to BN, but Fm not sure its useful to the decision makers. Another study by a Portland engineer calls the railroads diesel spill predictions into question. The railroads spill scenarios show even a catastrophic diesel spill would not reach the aquifer, but the state recently questioned that finding. Idaho Division of Environmental Quality officials Tuesday night said Farr had generally resolved their concerns with updated predictions. But the railroad's scenarios still dont show the full range of possible spill effects, according to a letter sent Tuesday to BNSF officials. In reality, if we have a spill out there the plume could be greater or less, said DEQ regional remediation manager John Sutherland.

The chances of it actually coming out exactly where this prediction says are slim. And Wade Hathhorn, a senior engineer with Economic Engineering Services Inc. in Portland, said its impossible to guarantee diesel would never reach the aquifer. Or that it would. Thats the problem with hydrogeology, theres so much uncertainty Hathhorn said.

If you dont put that as part of your caveats up front youre doing a great disservice. There are no absolutes here. The railroad will pay EWU $10,000 for the study, according to David Eagle, a finance professor and co-author. Eagle concedes that Power is right: Another site between Spokane and Sandpoint would bring the same economic benefits to the region. Whether its located at Hauser or three miles away, therell still be the same impacts, he said. But another site would come with additional costs to BNSF such as land purchases, he added. Power said he was asked by Friends of the Aquifer to look at the railroads economic impact study.

He said he has no interest in the depot and was not paid for his work. Officials from BNSF point to many economic benefits of building the depot at Hauser. Those benefits are based on an Eastern Washington University economic report done on behalf of the railroad. But Tom Power, economics department chairman at UM, says that a fueling depot anywhere in the region would provide the same benefits.

In a $11 million settlement, the BNSF admitted no liability. Heiders widow, Evelyn, urged depot opponents to stick together. They never apologized, Evelyn Heider said during a break in the hearing. That just about killed me. Shutts said the railroads treatment of the family is an indication of its unwillingness to take responsibility for problems.

But he cautioned that rushing to judgment is unfair. At this point, Id like for everyone to realize that someone charged with a crime is innocent until proven guilty in a court of law, said Hearrean. Valirees uncle, the Rev. John Stone, who spent the day monitoring developments at the Spokane County Courthouse, said Jackson deserved the death penalty. Im a minister, and I believe you get what you give, Stone said.

He took a childs life and sexually abused her. Valirees mother, Roseann Pleasant, disappeared in 1992 under mysterious circumstances. Stone, Pleasants older brother, believes Jackson played a role in his sisters disappearance as well. Police detectives investigating the Pleasant case tried to interview Jack-son in jail on Tuesday. Jackson declined.

The case against Jackson relies heavily on a Global Positioning System device attached on Oct. 26 to Jacksons 1995 Ford F250 truck, according to court documents. The device was installed after detectives obtained a warrant to search the truck, a Honda Accord and Jacksons parents home at 13313 E. Blossey. The affidavit justifying installation of the device remains sealed by court order.

Jackson and Valiree lived with Jacksons parents, Wilbur and Karen Jackson. Detectives said the older Jacksons are not suspects in the killing. The GPS device, which uses satellites to pinpoint locations within 100 meters, traced Brad Jacksons truck on Nov. 6 as it traveled to the remote Stevens County site where Valirees body was later found. At 1:30 p.m.

on Nov. 10, the system tracked Jacksons truck to a Spokane Valley site off Vicari Road. Sheriff Mark Sterk believes Valiree was first buried there, before her body was moved north. The truck was then tracked to the Stevens County burial site, where it stayed 30 minutes. Detectives got another search warrant to retrieve the device last Friday and downloaded the digitally-stored information.

The next night, officers picked up Jackson after getting a tip that he was suicidal. A shotgun was found in the back seat of his Honda Accord and he was taken to Sacred Heart Medical Center for evaluation. Detectives had searched the Spokane Valley site earlier Saturday, then began searching the Stevens County location between Springdale and Hunters on Sunday. Valirees body was unearthed there Monday. Jackson remains under suicide watch at the Spokane County Jail.

Child Protective Services received several complaints of child neglect in 1991 and 1992 involving Valiree, Pleasant and Jackson, according to CPS regional administrator Roy Harrington. Money donated to the Jackson family during the search for Valiree will be given to the Spokane County Search and Rescue organization and a fund for missing and exploited children. i u) rY) ''3 107 irr jf rj rf?
