The two were driving their cars and merging in heavy traffic when Mims claims he was called a racial slur by Michael. Mims is black and Michael is white.

When traffic stopped, the 6-foot-5, 295-pound Mims left his car, according to Michael, and punched his hand through the drivers side window. I never hit him, said Mims, 24. But Michael, 57, states he was cut by the glass from the shattered window. Mims is charged with battery, vandalism and vehicular tampering. Each count carries a maximum penalty of six months in jail and a $1,000 fine.
