Fleeing Bandits Slay War Hero short distance Morrissey put the car into forward speed again, the police swung around the detectives' car. Leaps on Car, Kills Thief Munk, who meanwhile had got out of the police car, was able to keep up with the stolen auto on foot.

He fired four shots as he ran, then jumped on the running board and when Morrissey refused to halt, fired two more shots at him. One bullet struck him in the head and another in the back, killing him. The frightened girl, who was unhurt, was taken into custody and said she was Helen Johnson, 28, of the Housman St. address. Police said the car was owned by the Quaker Oats Company of 17 Battery Place, Manhattan, and had been reported stolen earlier yesterday.

At 10 p.m. three youths walked into the Montauk Garage, 946 Union and told two attendants, James Birot of 673 Park Place and William Hendricks of 176 McDonough "We want a car." To emphasize their demand one flashed a revolver. While the armed bandit inquired: "Where's the cash?" his two pals jumped into a high-priced 1949 model and called to their companion, "Come on, let's get out of here." He jumped in with them without a further, attempt to get any money and they drove off. Trio Quickly Seized The attendants telephoned an alarm. The Police Department's telephone and radio communications system into action and in less than a minute Patrolmen William McGowan and Frank Spataro, cruising in their police car at Avenue: and Utica had a description of the stolen car.

Then they saw it approaching them and forced it to the curb. At the Snyder Ave. station, police said, the three occupants admitted the theft and said they were Richard Norman, 19, of 1126 Rogers Raymond Johnson, 19, of 483' E. 35th a and Joseph Wiley, 20, of 212 E. 35th St.

Norman, police said, had a loaded revolver. The stolen car was identified the property of Ann Hurley of 301 Garfield Place. Police reported also a safecracking job which failed because the three thieves involved couldn't solve the combination. The three entered the Auto Service Shop, 1508 Herkimer when only a night watchman, Alfred Miller, was on duty. One, with a revolver, stood guard over Miller while the others worked on the tumblers of the safe, trying to get it open.

After half an hour of trying they gave up and left. HUSBAND CAN'T RAPE WIFE, JURY DECIDES IN 1st CASE SINCE 1631 Leeds, England, July 15 (U.P.) -A jury decided today that a husband cannot rape his wife. It found Edward Clarke, 34. not guilty of rape in the first case of its type in Britain since 1631.

Counsel for Clarke asked yesterday that the indictment dismissed on the ground it was impossible for a husband to have illegal intimacy with his own wife. But the court ordered the trial to proceed because Mrs. Clarke had obtained a separation order before the alleged assault. Clarke was accused of raping his wife when he met her after the legal separation. The jury decided that the relations were legal.
