DRUNREN AND DISORDERLY PERSONS--A Test Case Oa Saturday last a youngman was arrested in the neighLorhood of the railroad, taken before Alderman Fisher, and charged with drunken and disorderly conduct. hearing of the case was postponed until Tuesday. At the hearing witnesses were examined.

and the charge sustained, when the accused was committed to the county prison for five days. lie was immemediately taken Out on a habeas corpus, but the alderman, desiring to make this a test case, proposed to hear testimony, and the accused was remanded to prison until this morning, when the hearing was had before a full bench. The authority under which this and similar commitments are made is section 5 of tbe act of March 31, 1853, and reads as follows lo That any or persons who may be convicted under existing laws, before the mayor or any other alderman of the city of Lancaster, or any justice ef the peace of Lancastf county, at, a vagrant, drutiken or disorderly person, shall for the first offence be sentenced to confinement at hard labor in the Lancaster county prison for any term not exceeding one month, ant for the second offence for any term not less than one month or more than three months, and shall be fed, clothed and treated as convicts in said prison are directed to be fed, clothed and treated." The Commonwealth was represented by Mayor. Atlee and Gen. Fisher, and the defendant by Hon.

J. Dickey and J. W. Jolmson, fog. The question resolved itself Into this single point, whether a magistrate had power to commit for one single act of drunkenness and disorder.

After brief arguments by the council and the citations of authorities, a majority of the Court decided that one act constituted the offence. A magistrate, therefore, has power to commit, under the act cited, for the first offence. The question being settled Gen. Fisher asked for the discharge of the accused, and the Court granted the request. TOTON MONDAY, THE 12TH a pair of GOLD SPECTACLES, in a green leather ease, on Duke street.
