Jurors took less than four hours to reject the defense claim the former motel handyman was crazy and unable to' understand what he was doing or to know that it was wrong to murder the three Yosemite National Park tourists.

If he had been found insane, he would have automatically been sentenced to life. The same jurors convicted Stayner last month of murdering Carole Sund, 42, her daughter, Juli, 1.9, of Eureka, and their Argentine friencf, Silviha Pelosso, 16, while they were staying at the lodge where he worked outside the park. Jurors now will begin the penalty phase of the case against Stayner, 41, and will weigh whether to sentence him to death or to life in prison. He already is serving a life sentence for another 1999 slaying, that of park nature guide Joie Armstrong. He had pleaded guilty in that case in a deal that spared him from a possible death sentence.

Prosecutors said proof of Stayner's sanity was in his confession to the FBI, in which he detailed his methodical and elaborate efforts to cover his tracks. On Monday, an attorney for Patrick Sheldon Suiter' argued that his misdemeanor conviction for disturbing the peace should be overturned.

Suiter used an obscene four-letter word in exasperation after getting no help from an investigator in a check-fraud complaint. In a rare split decision, the three-member Court of Appeals upheld the conviction a year ago. I Judge Darrel Perry, writing for majority, contended that the provocative word as it was used "cannot be reasonably interpret-ted as the communication of information or opinion safe-: guarded by the constitution." But Judge Karen Lansing argued that while the common 'obscenity was insulting, it was not enough to provoke someone to violence or to significantly disrupt the activity or routine of others. In her dissent, she warned that legitimizing arrest if "an individual uses the 'f-word' in an agitated conversation with a police officer or with any other person" creates a new circumstance for otherwise unjustified police arrests or searches. Suiter had gone to the sheriffs office at the request of a friend to speak to a detective about a Check fraud case in which the friend was the victim.

Judge pleads innocent to drug charges SALT LAKE CITY (AP) -Fourth District Judge Raymond Harding Jr. pleaded innocent Monday to two third-degree 'lelony counts of drug possession. Harding stood quietly as his attorney Ed Brass entered pleas. The judge was arrested July 13 after his family, called the police.

They gave police a bag containing what appeared to be cocaine. Harding is accused of using or possessing heroin and cocaine in his home, according to charging documents. Third-degree felony convictions carry a maximum of five years in prison and $5,000 in fines. He is out of jail on $10,000 bail. Harding, whose father is a retired judge, has been suspended from his judicial duties.

He's on paid leave because state law says a judge can't be suspended without pay. As Brass and Harding left the courtroom, Brass told reporters that this case is not being handled like other first time drug possession charges. "It's an unusual case. You've reporting that this is a usual case, this is an unusual Brass said. Paul Murphy, a spokesman for the Utah Attorney General's office, said the state will prosecute the case fairly.

"We're trying to handle it like any other case.
