Constitutional questions were raised yesterday in the case of the state against William Barkuloo, aecused of forgery of orders on the county auditor for warrants for witness and jury fees. On a motion in arrest of judgment anti sentence Eugene Fitzgerald and J. E.

Fenton, attorneys for the defendant, aubmit that the court has no juriadietton over the person of the accused. The information, they saY, does not inform him of the nature of the accusation against him. The article of the constitution providing that Offen eel required to be presented by indictment may he presented by information or by indictment la not self-executing, and the territorial laws guaranteeing to a person accused of crime the right of preliminary examination are not repugnant to the constitution and have never been repealed, altered or amended. and are still in force. Testimony in the case of the state vs. Oscar Pascius, accused of larceny 'from a drug store, was concluded yesterday before the jury in Judge Prather's court. The attorney for the state and defense were limited to one hour each in discussing the matter before the jury, and Assistant Prosecuting Attorney Baldwin took 15 minutes of his time for the opening argument on the evidence.
