Wednesday, November 27, 1996 The NAPA VALLEY REGISTER 5A No rest yet for the remains of Lash LaRue flores From Page 1A From Page 1A By JEFF WILSON Associated Press Writer LOS ANGELES Six months after his death, the remains of B-movie cowboy A1 Lash" LaRue have yet to reach a final resting place. His widow walked into a funeral parlor three days after heart failure killed the bullwhip-cracking star of low-budget 1940s Westerns. She wanted to view her husband's body and fulfill a deathbed promise. Lash said get a lock of hair and put it in a locket. That way he will always be with me," Marion Callahan LaRue said Tuesday.

But the corpse wasn't there. The mortician told me, Dear, I have very bad news. The body is gone. It seems to us that somebody cremated him ahead of time," said Mrs. LaRue, her voice cracking with emotion as she recalled the May 24 revelation.

She had missed the chance to see him one last time, to get that tuft of hair. Forest Lawn did the cremation too early. It was a mistake," said attorney Andy Jardini, who represents Forest Lawn Memorial Park, Hollywood Hills. The widow had wanted a funeral so she could join friends in saying goodbye to LaRue, who died May 21, four months after open heart surgery. LaRue, after all, had lots of friends.

He was a Hollywood cowboy icon known for his handiwork with a whip and trade mark black outfits in such films as Song of Old Wyoming" (1945), The Caravan Trail" (1945), Law of the Lash" (1947) and Mark of the Lash" (1948). Mrs. LaRue called Forest Lawn, just a few miles from her home, to handle the cremation of her husband of four years. She's been a widow three times; all three were cremated. Suspicious after the quick cremation foul-up, however, the widow isnt sure the ashes at Forest Lawn are really those of her husband.

1 asked to talk to the man who cremated him and (the mortician) said they fired him. I ran out and threw up and went home. This sounded phony to me," said the widow, striking a feisty tone. She has since refused to accept an urn which Forest Lawn says contains the actors ashes. "How do I know it's him? They say its him, but I wont take their word for it," said Mrs.

LaRue, returning to a melancholy demeanor. They won't tell me where my husband is," she said. My friends are calling and wondering about the services. I cant go out for the holidays or anything until I know where he is. Im a nervous wreck." I want to know what happened to the body.

Maybe they sold the body or put him a group grave. You hear all sorts of things like that these days." Jardini countered: Theres no basis for that worry. We assure her they are him." The lawsuit was filed sooner than expected because the Smarts lawyer, James Murphy, received information that Flores may be leaving his Arroyo Grande home In the next few weeks to join the armed forces. Murphy said Flores will now be served with a subpoena to appear in court, and asked to give a deposition. He said Flores may be allowed to invoke his Fifth Amendment rights on questions that could incriminate him, but he expects that a Judge will order Flores to answer questions that are not directly Incriminating.

If Flores Implicates himself during his civil trial, his testimony can be used against him later In a criminal case, Murphy said. In an addendum to the suit against Flores, the Smart family also expects to bring charges against the Cal Poly Police De-partment for mishandling the i case in the weeks following Kris- tins disappearance. Campus police initially treated Kristin as a runaway, and by the time they began to investigate her disappearance for foul play, Flores had cleared out his room, and most possible witnesses had left the college for the summer. Murphy said the Smarts also believe that campus security was lax, and that a tighter secu- rity system could have saved Kristins life. If the Cal Poly Police Department does not attempt to settle the suit within 45 days, it will be added to the suit as a second defendant, Murphy said.

Were really disappointed with the way the Cal Poly Police Department handled this," Smart said. They really let a lot slip through their fingers, and they couldve handled it in a more serious light. At the beginning, they were telling us that Paul Flores was a nice kid, and that we should Invite him home for the holidays. Well, here it is Thanksgiving, and we dont have a daughter for him to come home with. Cal Poly police could not be reached today for comment.

Timar has lived in Napa for Just over two years and is a professor of educational policy, teaching both at UC Berkeley and UC Riverside. He has also been an educational consultant for the state Legislature. Id like to give something back to the community," Timar said of his reasons for applying. Cuney said her candidacy for City Council probably had something to do with why she wasnt selected. If elected to council in the March election, she would have had to give up her commission seat.

More time for campaigning, Cuney said. The only other commission for which there was competition was the Tree Advisory Commission. 1116 city received six applications for five vacancies on the five-member body.
