The lawyer said Lambert poses no risk of flight and is no threat to the Lancaster community. Lambert did not appear in court Tuesday. Instead, Rainville presented Stengel with a sworn statement signed by Lambert. I am more than willing to submit to any form of custody in lieu of being in prison, Lambert said in the statement. I am willing to be under house arrest; wear monitoring equipment; or do whatever else the court requires.

Lambert said she will continue to fight for her freedom rather than flee. Judge Stewart Dalzell last spring into the state court record of the Lambert case. Rainville told the judge he will have more than enough evidence of misconduct from the previous testimony of police officers during the federal hearing to reach the same conclusion that Dalzell did without the unjustifiable expense of another long hearing. Dalzell overturned Lamberts murder conviction and freed her, saying police and prosecutors framed an innocent woman for Shows death. A federal appeals court, however, reversed Dal-zells ruling because Lambert came to federal court before exhausting her appeals in Pennsylvania courts.

Lambert was sent back to jail in February. Judge Stengel questioned Rainville concerning how he could make findings of fact based on the credibility of witnesses by merely reading a cold transcript. How am I to deal with credibility of witnesses on a (federal) record that now occupies two full shelves in my chambers? the judge asked Rainville. Rainville suggested to Stengel that reading the testimony of eight Lancaster County law enforcement agents alone would If I were to flee, people would say I fled because I was guilty, Lambert said. I will not have my daughter growing up being taunted by cruel people who would no doubt say her mother is a murderer.

I would rather spend the rest of my life in prison, declaring my innocence, than let that happen. At the hearing, Stengel, who convicted Lambert of first-degree murder during a nonjury trial in 1992, will decide if theres enough evidence to warrant a second trial for Lambert. He could also decide to free her unconditionally because of prosecutorial misconduct during her original trial here six years ago or he could uphold the guilty verdict. The state Supreme Court on Feb. 25 ordered the judge to hold the appeal hearing and render a decision within 120 days.

At Tuesdays court proceeding, the judge was handling outstanding legal issues that need to be resolved before the hearing can begin. Stengel made no immediate decision on Lamberts request for bail or a second issue Rainville put before him Tuesday. Rainville also asked Stengel to enter the record from Lamberts three-week federal appeal hearing before U.S. District Construction equipment is everywhere. Later in the hearing, Stengel scolded the media for claiming in court filings he was trying to halt reporting of the Lambert case or conceal any court proceedings in the case.

There is no interest on the part of this court in shutting down the press; that is ludicrous. To suggest there is some interest in conducting this in secret is really insulting, the judge said. It is a gross miscasting of the truth and I resent it. Christina Rainville, Lamberts attorney, supported the medias case. She said Lambert would argue all the way to the U.S.

Supreme Court, if necessary, that she cant be retried because of the extensive prosecutorial misconduct during her 1992 trial in Lancaster. Werner argued theres no support in the law for a judge to enter a gag order in the case of a criminal appeal simply because it includes the potential for a new trial at some unknown later date. Whats more, the lawyer told the judge, the case has been covered by the media for almost six years and the coverage will continue as the case proceeds through the courts.
