Associated Press KANSAS CITY The mother of an 11 year-old girl who died after being trapped in a swimming pool drain has settled a lawsuit against the church that operates the pool. Kathryn R. Cetto settled the lawsuit against Central Bible Church of Kansas City for an undisclosed amount of money Cetto's daughter, Kelsey Ruwe, died Sept 5, two days after she was trapped in a drain at the bottom of the church's pool. Dennis, 29, Dearborn, for six months after pleading guilty to misdemeanor charge of third-degree assault; must complete family vk- gently shut. His chest heaved twice, he coughed hard, then he took one deep, final breath. But he never opened his eyes. Malone attorney Peter Gianni-ni claimed Malone was innocent of all three murders, that a friend of Malone's, Michael Crenshaw, actually committed the crimes. "Not a chance," said St.

Louis County prosecutor Bob McCul-loch, who handled the case in 1984 and came to Potosi to witness the execution. McCulloch said Malone's motives were never really clear. "He was mean," McCulloch said. "Some he robbed. Some he just killed to Also left unanswered was what happened to James Rankin.

He vanished March 19, 1981, after a late meal at the Denny's Restaurant in downtown Kansas City. Authorities believe Malone and Crenshaw abducted and killed him. A search of six states found no body, and neither man was ever charged in the case. The fact that Malone was on death row simultaneously in both California and Missouri created a legal tangle that ended about a half-hour before the execution. On Monday a federal judge in California overturned the death sentence there, but not the conviction.

Christopher Chamberlin, 17, 2766 Jackson pleaded guilty to a misdemeanor charge of second-degree property damage.

He admitted damaging a diesel tractor owned by Pik-A-Pine Farms on Missouri Highway A in St. Joseph on Sept 19. Several trees also were damaged. Associate Circuit Judge Keith Marquart placed Mr. Chamberlin on two years probation and ordered him to pay a fourth of $5,612 in restitution at the rate of $100 a month.

He also must perform 80 hours of community service. Hearings in Savannah slaying reset for Feb. 3 SAVANNAH, Mo. Preliminary hearings for three men charged in he Oct 31 slaying of a 32-year-old Savannah resident were rescheduled Wednesday for Feb. 3 in Andrew County Circuit Court.

Byron Brushwood, 24, Michael Rauch, 42, both of Oregon, and Shawn Rauch, 21, rural Amazonia, are charged with first-degree murder, unlawful use of a weapon and armed criminal action in the death of Randall Crawford, who was slain with an arrow and bullets. 3 arraigned on charges of manufacturing meth ALBANY, Mo. Kelvin Malone flied quietly Wednesday leaving unanswered questions about a murderous rampage 18 years ago that left three people dead, maybe four. "Malone was put to death by injection at 1:20 a.m. at the Potosi Correctional Center for killing a i St. Louis cabdriver in 1981. The execution was delayed a little Riore than an hour while the U.S.

Supreme Court weighed, and ulti-; Vnately denied, a last-minute appeal. 1 his final days, Malone offered no details of a crime spree that began in St Louis and ended Six days later in California. In addition to the Missouri killing, Malone was convicted of murdering two women in separate inci-i dents in California. Authorities believe that along the way he I killed a Kansas City businessman I whose body has never been found; 1 Malone refused interview requests, offered no last words. He remained quiet to the end.

As the first of three lethal drugs was administered, Malone's eyes were In the courts Slayer files lawsuit to overturn sentence CAMERON, Mo. A Kansas City man serving a sentence of life plus 100 years in prison for killing a Kansas City, man in St. Joseph on Aug. 5, 1995, has filed a motion to have his sentence set aside. Bryon Lerone East, 31, who also goes by the name Solo, an Inmate at the Western Correctional Center in Cameron, has filed a civil case to set aside his sentence alleging ineffective assistance of counsel.

He appealed his conviction efter a three-day jury trial for front of a house at 1906 Edmond I but the Missouri Court of Appeals for the Western District I. denied his appeal and affirmed the decision of Buchanan Coun- ty Circuit Judge Patrick Robb on i Oct. 22. Mr. East was sentenced as a prior and persistent offender and will have to serve 85 percent of his time before he'll be eligible I for parole.

I XNo date has been set for a hear- ing on the case. pan admits he stole items from police car A St. Joseph man pleaded guilty Wednesday to two charges stealing, including taking items from an unmarked police Vehicle. William Schroeder, 19, 1604 Elwood pleaded guilty to two misdemeanor charges of stealing. Mr.

Schroeder told Associate Circuit Judge Keith Marquart he took stereo equipment from a car on Dec. 22. He also entered an unmarked police car parked in the driveway of Detective Jonathan Beaver and took a Solice radio, fingerprint kit and ash-mount red light. Marquart sentenced Mr. Schroeder to 90 days in jail on each count and ordered the sentences to be served concurrently.

Mr. Schroeder also appeared Circuit Judge Patrick Robb later in the day on a motion to revoke his probation on a misdemeanor charge of first-degree property damage. He'd pleaded guilty in October 1996 to property damage and receiving stolen property. On the property damage charge, Mr. Robb sentenced him to five years in the Department Of Corrections, suspended the Sentence and placed him on five years probation.

Mr. Schroeder received six months in jail on the stolen property charge. On Wednesday Mr. Robb revoked Mr. Schroeder's probation and executed his five-year prison sentence.
