14--Briefs in the case of Mrs. Virginia Berge, 27. of Forestville, who is seeking an appeal from the sentence of 20 days in jail imposed by Dunkirk City Judge Raymond Bartkowiak for public intoxication, were filed in county court here Monday, Judge Robert N. Palmer presiding. Mrs.

Brege was arrested on Feb. 18 when she was found asleep in her car on Lincoln avenue near the Nickle Plate tracks. Her Attorney, John L. Sullivan of Dunkirk, pointed out that the fact that his client was asleep was not evidence that she was intoxicated and also that the courts' during prohibition had ruled that a person's car was a private place. District Attorney Edwin G.

O'Connor stated that the woman's small son had been with her and left the car, later bringing a policeman to the car where his mother wai sleeping. The case of Raymond Burgun of Forestville was adjourned for two weeks. He is seeking an appeal of three fines imposed by Justice of the Peace Harrington of the town of -Hanover. Burgun was fined a total of $200 on charge of operating a vehicle with improper registration, no operators license and improper license plates.
