CBS News reported Monday that Flagstar Cos. the corporate parent of Denny's, would settle pending bias lawsuits by paying $45 million and hiring an outside monitor to check on its civil rights policies.

Five shot in botched holdup INDIANAPOLIS (AP) A about two dozen customers and Five-year-old Justin Basicker was restaurant manager tried to wrestle a gun away from a holdup man, touching off a shooting spree and a six-hour hostage standoff that left one dead and four others wounded, police said. Ron and Thomas Mathisen entered the Denny's Monday as a lunchtime crowd was gathering.

But after the manager was shot during the struggle for Thomas Mathisen's 9 mm pistol, his brother "went crazy" with a caliber handgun, said Sgt. Frank Evans. "(Thomas Mathisen) was real upset with the manager for grabbing his gun," Evans said. "He said, 'Nothing would have happened if he hadn't grabbed my gun." Ron, 27, and Tom, 24, took restaurant employees hostage, then let them go in groups of four or five while negotiatiating with police. After police promised the brothers they could talk with family members, the last hostages were released about 5 p.m.

and the brothers surrendered peacefully. They face charges including including murder, attempted murder and attempted robbery. John Adams, who was sitting near the front of the restaurant when the shooting started, fled with about 14 others. "I heard one shot, then I heard a hesitation of about three or four seconds, then I heard about five or six more shots," Adams said. Alfred Smith, 71, was killed.

shot in the mouth; his mother's boyfriend, Steven Johnson, was shot in the back; and Cecil Williams was shot in the hand. Johnson successfully pleaded with the gunmen to let him take Justin to a hospital, where the boy underwent nearly six hours of surgery and was in serious condition today. The Mathisens are from Casper, Wyo, where they are suspected of embezzling $4,000 last week from the adult bookstore where they worked, said Lt. Jack Watters of the Casper police department. They apparently chose Indianapolis and the Denny's restaurant at random.

"They pulled a map out, saw Indianapolis and decided to come here," Evans said. 924-3484 584-9249 Lemoore Hanford Rd. 11th at Grangeville Domestic violence rising in military WASHINGTON (AP) Spouse and child abuse is on the rise among military families, and the army will assign civilian counselors to hundreds of military units next month in an effort to curb it, a Pentagon spokesman said Monday. Confirmed cases of spousal abuse in the military rose from 12 per 1,000 spouses in 1988 to 18.1 per 1,000 in 1993, according to Lt. Col.

Doug Hart. Child abuse cases rose from six per 1,000 to 6.6 per 1,000 during the same period, he said. On average, one child or spouse dies each week at the hands of a relative in military families, statistics the indicate. The increase has Pentagon and congressional officials worried, though the rate of child abuse is still about half that in the general population, according to a report Monday in The New York Times. Part of the increase might be attributed to better reporting of incidents, the Times said.

But military experts also believe cutbacks in the military and the impact they have on people's careers are playing a role. "There's no question that the downsizing has had a real impact on the active-duty military and their fainilies," said Peter J. McNelis, a former Army colonel who heads the Military Family Institute at Marywood College in Scranton, Pa. "You can't talk to anyone without getting the sense they're tense and feel that the system is letting them down."
