Court Denies Motion CHE GETTYSBURG TTMES. TUESDAY. AUGUST 9. 1977 Judge John A. MacPhail recently denied a post trial motion filed in county court by Kenneth Eugene Thompson, Westminster.

which claimed that the defendant was denied his constitutional right to a speedy trial. He was convicted in April of burglary and theft charges. The post trial motion contended that the charges, which were filed in connection with the August. 1B76, break-in at ihe Rea and riek Drug Store on Lincoln Square, were lodged on October 1,1976. and the ease did not come to trial until April 23.

1977. allegedly breaking the 180-day time limitation placed on criminal proceedings. In his court opinion. Judge MacPhail upheld the convictions, ruling that the -evidence favorable 10 the Commonwealth was sufficient for a jury to find the defendant guilty of both crimes." He went on to deny on two grounds the contention tiiat Thompson was tried in violation of the 180-day rule. DEFENDANTS MOTION Judge MacPhail first noted that on April 12.1977.

prior to Thompson's trial, the defendant filed a motion for a continuance to postpone his trial and had himself signed a written waiver of the 180-day rule. Although the motion for continuance was denied by the court, the judge maintained that the voluntary written waiver isstill binding upon him since it was never withdrawn. Secondly, the judge ruled that "the defendant is obligated to apply for an order to dismiss the charges before trial if he desires to raise the question of his right to a speedy trial." and since no action was taken prior to his trial." the objection is without merit." The udge ordered sentencing of Thompson on Sept. 13. pending a presentence investigation report.

Arguments End Today In Mandel Fraud Case BALTIMORE A i -Lawyers were scheduled to conclude closing arguments today in the political corruption trial of Gov. Marvin Mandel and five eodefen- dants. U.S. District Judge Robert L. Taylor said Monday he may instruct the jury and initiate deliberations in the 10-week-old trial later today- Otherwise, deliberations will begin Wednesday.

Arnold Weiner. Mandei's lawyer, was scheduled to argue the governor's case this morning, followed by a government summation bv Asst. U.S. Atty. Barnet D.

Skoinik. Mandel is accused of accepting an estimated $357,000 in business interests, cash. Florida vacations and gifts in return for trying to get the 1972 Assembly to legislate benefits for Marlboro Race Track. At the time Marlboro was secretly owned by codefendants W. Daie Hess.

Ernest N. Cory Jr. and brothers William A. and Harry W. Rodgers III.

The sixth defendant. Iran Kovens. denies a government claim he owned 60 per cent of the track- Each defendant is charged with 20 counts of mai! fraud- each carrying a maximum penalty of five years and a $1.000 fine. Mandel. Cory and Kovens face one racketeering count, the others two each.
