In the Common Pleas Court Judge Blddle has made absolute the rule grouted in the proceedings brought to open a judgment for over $121,000 In the suit brought by Frank Mnuran, under a mortgage against Henry I. S. Warfield. It Is claimed that Peniberton of which Arm the plaintiff ia a member, sold a Urge tract of ground at Thirty-first street and Montgomery ave nue to the defendant, Henry I. S.

Warfield, reserving certain ground rents, which were really the consideration for the conveyance. Warfield was a carpenter and builder and entered Into an agreement extemporaneously with the taking of the title to erect on the property conveyed to Mm forty-lx houses. To secure the carrying oat of this agreement he executed to Frank Mauran, a collateral blanket mortgage for $110,000, payable In one year from the date of Us execution. It is contended by Lawyers W. W.

Porter and F. J. Gelger for the defendant, war- field, aud the terre-tenants that the mort gage was given solely to secure the faithful performance of the building agreement, and mat tne snie winon loiioweu wuh nn.nm. After Wm-flpid luid entered noon the nron- erty and commenced operations he became Indebted to freorge S. Yerkes for lumber and mill work furnished by Yerkes to the opera tion, anu agreea to convey to nun in release of his six houses, subject to the trrmind rent find the blanket mortirnee.

Yerkes in hfs turn wns indebted to other parties and Instructed Warfield to convey lour oi tne nouses to tue recuruy n.vewi-ment ('omnnnv in trust for his creditors. Afler this was done Yerkes gave Warfield a release. The conveyance was the fourth made by Warfield. leaving about thirty lots or grouua auo nouses sun in ins Msfssiim, A writ was issued linon the blanket mort gage and judgment for the want of au appearance was entered for On this execution was issued against tne properties mentioned and twentv-nine others. The sale, which afterwards took place, is alleged to have been Inequitable.

A rule wns taken to open judgment, and let the terre-tenants into a defense. By the making of this rule absolute, the innter is now to come before a jury to bo panned upon. It Is urged that it has been shuwn that there is an equity in tne remaining nouses or tne operation outside of the ground rents, and the houses In question of while Mr. Mauran ciaitn is ror only SENOR EWING'S VISIT He Comes to Philadelphia to Promote Chilean Trade. To-morrow will be a big day on the palace steamer Republic, as the managers announce that they will give a special ocean trip and the only one that will be made on Sunday this season. This ocean trip Is one of the most attractive features of the journeys to Cape May aud invariably attracts wide-spread attention. They offer a most admirable opportunity for deep-sea travel and as It is the only trip of the kind that is placed within the reach of Philadelphians it is not to be wondered at that they are. Invariably, eagerly awaited. This extra run is made after the passengers are landed at Cape May and is Interesting in many ways.

The sail out among the cool breezes of the Atlantic Is extremely pleasant on these hot days, and it Is hard to find any trip or outing moie refreshing or invigorating. The boat rides over the waves as firmly as the best of ocean liners, reducing the chances of sea-sickness to a minimum. A rnns and decidedly- pleasing attraction is the scenery that can be viewed on those trips. Cape May city, with all Its various hotels. Important buildings, long pier, light-houses and, above all, its famous beach, is plainly discerned as the steamer, when opposite the popular summer resort, keeps close to shore.

The route for the first few miles Is directly around the extreme southern and eastern shores of the Now Jersey const that is lined with objects of interest and scenery which everyone wants to see. The passengers can either stop at Cape May or go ont on the ocean trip, and this will be the only one given on Sunday this season. The Markle Estate Dispute. Ida Markle Hessenbruch and Herman Hes-Benbruch, her husband, yesterday filed an answer In the Orphans Court to the petition of S. A.

Barber, guardian, and others. In which the settlement of the Markle estate is asked to be reviewed. Numerous particulars are recited In the answer bearing on the controversy, and it is clnimed that the sale of certain property of the estate to Ida' Markle HesHenbrueh and to her brothers and sisters was just and made for a full ani fair price. The court is asked not to authorize the making of a different lease for certain coal lands and not to change the relations and obligallons of the members of the present firm of G. B.

Markle Co. Trains at Every Desirable Hour run between Philadelphia and Atlantic City, over the Pennsylvania's double lines. The schedule is perfectly adapted to the requirements of all travelers.
