Wilson. The panel of five-women and seven men received the case yesterday noon in the court of visiting Judge Pat Mullendore of Los Angeles Superior Court.

It returned during the afternoon to ask questions about the evidence. According to Ivaldi, Agero came to Oakland from McAllen, Tex. last April with a sample of drugs for sale. Kemp and Willard Thomas, a narcotics associate of his, were excited at the quality of narcotics Agero offered and arranged to buy more.

When the shipment arrived, however, Kemp and Thomas were angry because thq new" drugs were of poor quality. Ivaldi said K6mp vowed to kill Agero, and set up another buy to, lure him back to the Bay Area. Both sides in the murder-arson trial of Barger and three other Hells Angels completed their opening statements yesterday and began questioning the pathologist who examined the victims body, found in the bathtub of a burning house on Mountain Boulevard last May. Donald P. Whyte, senior trial deputy in the Alameda County district attorneys used his opening argument to give the jury, of six men and six women what he called a history of the events leading up to and he death of Servio Winston Agero, 29. In doing so, he went into lengthy detail on the murder of Jthree Other men, found slain a house near San Leandro the next day. Superior Court Judge William Hayes repeatedly overruled defense objections Whytes references to the later deaths.

Whyte said the key prosecution witness, Richard Ivaldi, was in the Mountain Boulevard home when Agero was killed, helped carry his bqdy the bathtub and watched Barger spread gasoline through the house. and his wife, Anita, arrived, 'along Donald Duane Smith, a third defendant in the murder trial. There was a Sale of a portion of the-perhaps $90,000 worth of drugs Agero carried, and the motorcyclists left. Early irt the predawn hours of the next day, May 21, Walton asd Smith returned, accompanied by disguised Bargei and Gary Popkin, another Hells Angel and the fourth defendant in the case. After the murder, Ivaldi maintains, everyone left the house otie by one except Ivaldi and Barger, who by then had removed his disguise.

Later that morning, Waiton and Kemp returned, at Bar- gers orders. When a police car cruised past, Barger ordered the house burned. When a kitchen pilot light set off the gasoline with which the house had been doused, the four men went to Bargers house and listened to the Oakland police radios accounts of finding Agcros body. About 9 p.m., Barger, Ivaldi and Popkin set out to take Ivaldi home, only to find the area filled with police. Ivaldi only learned later that this activity was due to the discovery of the bodies of Kemp, Thomas and Kelly Patrick Smith, whom Ivaldi identified as another member of Kemps ring.
