As Blackmuns opinion showed, in referring to his personal abhorrence for the death penalty, it could be very hard to give tacit approval to someone elses moral judgment in favor of death sentences. So, the country can have no doubt just how far these judicial conservatives are prepared to go with their refusal to use the law as a liberating force in society. With the four conservatives unwilling to strike death sentences as a matter of law, the pressure was consequently much heavier on the courts middle men, the moderate Justices Potter Stewart and Byron R. White. Peter and I plan to be married within, the next six months.

Still, there is no reason to think that leaving the issue to others is not a moral judgment of its own. That puts the judge in the position of ratifying, by implication, the legislators views on cruelty.

Four justices of the court came close to that position. They are the four who were listed as the dissenters from the result the court reached: Chief Justice Warren E. Burger and Justices Harry A. Blackmun, Lewis F. Powell Jr.

and William H.Rehnquist While each insisted that the phrase cruel and unusual punishment could have a changing meaning constitutionally, they felt that any changing should be left to federal and state legislators.
