Judge Russell waived examination, and Justice Fowler took his recognizance for $50 for his appearance at the next term of the Superior court of New Han-oyer county. 'The spectacle was a disgraceful one, and while it is none of our fight, we constrained to say that Judge Russell's attack on Mr. Rice was a piece of cowardly bulldozing. The preliminary hearing in the casej against Ed Byrd and James Evans, the negroes charged with burglary, in enter-' ing and robbing Mr. JohnR. Turrentine's residence, which was postponed from Thursday and Friday, took place yesterday before Acting Mayor W. N. Harriss at the city hall.

Herbert McClammy, appeared as counsel for Evans, but Byrd had no counsel. Messrs. Morgan Turrentine, and C. H. Robinson, whose room was entered and robbed, testified to the facts as to the burglary, heretofore published in the Messenger.

They also testified as to the property stolen and identified the gold watch, the shoes and other articles recovered as theirs. Sergeant Robert Green, who went to Newbern and arrested the burglars, testified to that fact; and to the fact that he found some of the stolen property in' their presence. He also testified that Byrd implicated Evans and said he was with him when he entered Mr. Turrentine's residence. Jim Garrison, colored, testified that he saw Byrd and Evans trying to sell some of the things in Newbern.

No witnesses were introduced by the accused and they made no statement in their own behalf. The offense charged being a capital one, the prisoners were bound over to court without Rev. It. C.Beamon to Preach. The Rev.

R. C. Beamon, of Goldsboro, arrived here yesterday, and in the absence of-the Rev. W. C.

Norman, pastor of Grace M. E. church, will preach today at 11 o'clock ar and 8:15 o'clock p. m. in that church.

Mr. Beamon is one of the ablest ministers in the Methodist church of North Carolina, and made hosts of friends among Christian people of all denominations while pastor of Fifth Street church a few years ago, He is gifted with eloquence, is profound thinker and cogent reasoner, and his sermons are possessed of a literary finish and logical strength that make them a treat to all who hear this distinguished preacher. He will no doubt have large congregations at both services. We must sell out our boys' suits. Let us sell you one at some price? Naum-burg.

Bice The Court to. Settle the Hatter. Judge Russell and Mr. Fred B. Rice, city clerk and treasurer, are Republican brothers, but they don't get along in a brotherly way.

In the recent war of words between them at the city halL it will be remembered that Mr, Rice told the Judge he didh't give a for him and his methods, and told Mr. Rice he was a that the Judge scoundrel and a traitor to his party No collision took place, but previously and subsequently ood" between the there has been "bad two politicians. Yesterday, a jfew minutes before 4 o'clock, City Clerk ajid Treasurer. Rice left the city hall and camedown Princess street to the office! of City Attorney David B. Sutton, who isj in charge of the collection of the back taxejs.

He has his headquarters in the front room of Judge D. L. Russell's cpffice at 114 Princess street, between Front and Second. Mr. Sutton had obtained from the city clerk and treasurer ja tax deed book which he wanted in his office in connection with the steps being taken for the collection of the pack taxes.

Mr. Rice says the book was loaned with the understanding that it would be returned at 5 p. m. in the afternoon, as he wanted to lock it up in the safe over night for safe keeping, being responsible for the books in his office. Th book was not returned at 5 o'clock on Friday afternoon and Mr.

Mr. Rice said it was the understanding for the book to be returned at 5 o'clock and that they must send it back. He told Mr. Bunting he did not mind accommodating him but so far as "they" i were concerned he didn't give a for them. Mr.

Bunting gave Mr. Rice the book, saying it was no accommodation for him but the attorneys. At the same time Judge Russell, vrho was back in his office and heard the conversation, rushed out and told Mj Bunting that he had better give the book, to Mr, Rice and asked Mr. Buntihg what it was Mr. Rice said about "they." Mr.

Bunting told addressing himself him, and the judge to Mr. Rice asked him what he meant by "they." Mr. Rice replied that it was a personal pronoun, and referred to the back tax attorneys, not necessarily to him. The judge applied an epithet and an oath to Mr. Rice and I said he wouldn't allow him to come to his office and in suit him.

i I i i Mr. Rice "cussed" back at Judge Rus sell and told him tioned his name; that he never men that he was not in his office and that hej was on the street and would say what he pleased. Judge Russell excitedly exclaimed: 'You are a ri scoundrel and a trai tor to your party, If Mr. Rice retorted that if he was a scoundrel and traitor the judge was another. The judge ripped ou an oath, and said, if you say that Til shoot you.

Mr. Rice yelled back: "I am not armed but I'm noi; afraid of you, you. You havenjt got grit enough to shoot anybody." il Judge Russell excitedly: drew a pistol from his hip pocjeet and advanced to the window pointing it' at Mr. Rice, who hurriedly jumped pown in the basement under the piazza 4 ver the entrance to Mr. Josh T.
