Since our last, Franck Stanly and Hamilton C. Graham, of Newbern, John Winslow, of Fsyetteville, and James Bogan, of Anion County, have been admitted to County Court practice. The Upper Canada Gazette says, that a servant girl in the village of Gore, while taking in clothes which had been drying on a line, put the pins, as usual, in her mouth several of which she accidentally swallowed, and one of them became entangled in her throat. A surgeon was sent for, who succeeded in removing the pin from her throat, but the poor girl suffered violent spasms in the stomach, which were succeeded by convulsive fits, which continued with but short intervals for several days, and her recovery was considered Court of Equity, April Term, A D. 1829.

John incompetency or we presume, cannot be alleged against the Doctor. The height and front of his offence was a decided preference for the late administration, while his successor, whatever may have been his early prejudices, was a good Jackson man, and we take pleasure in adding, will make a good Collector. If we notice occasionally the progress of the present system of vindictive, undlscriminating proscription, it is not front any wish to enlist the sympathies of the public, or to indulge in unmanly On this subject, our views accord with those of a late correspondent's. At one time, they were justified on the principle of discouraging an interference on the part of the officers of the Government in elections' but the absurdity of this plea soon appeared, when it was found that no Jackson man, however gross or infamous his interference may have been, was removed on the contrary, it was made a reason for promotion.

At another time, it was asserted The voice of the people public sentiment' called for those removals! when immediately cases multiplied where The voice of the or 'public sentiment' elevated the removed to the first offices in the gift of their respective states. So the voice of the people would not answer. It was then urged, that officers were removed because they had abused thdr trusts' 'wen incompetent' when instances occurred, where Jackson men, with every opportunity of judging, such as judge McLean, our late Post Master General and Noab, furnished the most full andasatisfactory testimonials of the zeal, integrity, and efficiency of many of the officers removed. And finally, what can be more base or pusillanimous, than the attempt which the Jackson Press is now making, to fasten the delinquency or malversation in office of one individual, on the whole corps of talented and virtuous public servants of the late administration officers who- have enjoyed, and deservedly too, the confidence of Jefferson, Madison, and Monroe, and against whose fair fame the taint of suspicion has never breathed what gratuitous, audacious malignity It is of this open and palpable insincerity on the part of the rulers of our country that we complain, which is alike insulting to the understandings of the people, and calculated to sap the moral principles of the country. The British Government, and enterprising British capitalists, are making great efforts to improve the quality of East India Cotton, and for that purpose ore adopting various expedients among others, it would seem, that of procuring the seed, in large quantities, of our best growths of uplands. Outlawry of the Bank of the United Statet in Alabama. We noticed, a day or two ago, says the American, the decision of Judge Crawford, of Alabama, that the United States' District Courtjcould not entertain jurisdiction of the cause in which the United States' Bank was a party. The editor of the National Gazette says, he has had an opportunity of examining that decision, and that it proceeds from a technical objection to the exercise, by his Court, of powers heretofore supposed to belong to it, and not specifically against the Bank. Tlw National Gazette thus explains the difficulties of Judge Crawford: The District Court of Alabama derives its powers from an act of Congress passed in April, 1 S20, which declares that the District Judge shall have the same jurisdiction and powers which were given to the District Judge of Kentucky by an act of Congress in 1789 This act of Congress of 1789 declares that the District Judge of Kentucky shall have jurisdiction "in all causes Court of Pleas and Quarter Sessions, Term, 1829.

The U. States sbip Erie, Captain Turner, anchored in Hampton Roads yesterday. The Erie is from PensacDla, whence she sailed on the 2d inst. touching at Tortugas on her way. Com.

Rodgers and Col. L. Baldwin, who were on a visit to Pensacola to examine that harbour with reference to the selection of a she for a navy yard, have returned in the Erie Cora. Patterson, who went with them, was taken sick at New Orleans, where he remained at the last advices. Samuel Hamilton, Esq.

"Newbern is situated on the South side of Nevt River, with a pleasant prospect of that River: This Town has but a few houses or inhabitants in it at present. "Handcock Town is seated on a North-west branch of Neus River, being about two hundred miles from the mouth of that River, and is scarce worth taking notice of, only for its being formerly an Indian Town, and where they had a fort ia time of war. "Beaufort Town stands on the North side of Newport River, its prospect being as pleasant as any of the former It is small, and thinly inhabited. "Brunswick Town is most delightfully seated, on the South side of that noble River Cape Fear; and no doubt but it will be very considerable in a short time, by its great trade, the number of merchants, and rich planters, that are settled upon its Banks, within these few years. The streets in these Towns aro as level as a Bowling-Green, there being no manner of pavement to bo met with over all this Province." An article in the last Sentinel, concerning the right of Congress to make internal improvements, contains a pro" position which we cannot but regard as an extravagant paradox in American politics.

It is this That a solemn determination by Congress (that this power belongs to that body) is recognized by the Constitution as the supreme law of the land." Surely the Constitution cannot regard any thing contradictory to itself as the supreme law of the land; and Congress may sometimes pass a law not authorized by the Constitution. Nor can we perceive how a matter can be said to be judicially determined, which has never been the subject of judicial considerationnor do we perceive, because it ha been judicially determined that Congress has a right to incorporate a Bank, that it follows "by parity of reasoning" that it has also the right to make internal improvements." 1 75 6 6 22 Russia and Sweedes, do. Thus, the District Judge of Alabama has no power except what the District Judge of Kentucky had and the District Judge of Kentucky had no power except what was given by the same act of 1789 to the Circuit Judges and as this act was passed before the bank was established, it does, not include jurisdiction of its concerns.

The charter of the Bank gives jurisdiction to Circuit Courts in cases in which the Bank is concerned, and if the act of 17S9 had given to tho District Judge of Kentucky power in all causes hereafter made cognizably in a Circuit Court," the power would have attached or accrued. It does not, however, say hereafter, but herein' after, that is, in the law of 1789 itself. The Judge, therefore, says he cannot execise a power not expressly given to him, and he has no authority to repair the inadvertence or omission of Con gress. He adds, as an evidence of the manner in which the act organizing the Court was framed, the following statement: It cannot have been forgotten by some members of this bar, that many evils were suffered in consequence of an error committed by Congress in the law establishing this Court. The bill was introduced into the Senate early in the year 1820, with a provision that the first term of the court should be holden in 'April intending April, 1820.

It did not become a law untill April in that year, and it passed with the words April next," as originally introduced thereby the first term of the Court was postponed for one entire year after its establishment. It was not conceived either by the court or the bar that a term of the court could be holden in April, 1820, although this was clearly the intention of Congress." The case will, we understand, be finally decided by the Supreme Court and if the opinion of Judge Crawford be sustained, it will require the interposition of Congress, as his construction will limit tho power of the District Court, not solely with regard to the bank, but in relation to many of the objects of national legislation hitherto deemed within the jurisdiction of that tribunal. Varnish, do. In the progress of Mr. Adams's unostentatious journey homeward, during which he studiously avoided all public demonstrations of respect, especially on account of his recent severe family affliction, he was, nevertheless, visited in the principal cities by large numbers of his friends and fellow citizens, desirous of manifesting towards him their respect and esteem. He has now returned to bis native State, where there are but few who do not highly respect and value his public services and private virtues. The new Waverley novel, Anne of Geierstein," is issued this day by Messrs.

Carey, Carey, in two duodecimos. We mentioned some time ago that we had read the first volume of the London edition, and augured very favourably of the work. Yesterday, we perused the remainder, with lively interest and satisfaction. The narrative fixes attention, and a most skilful use is made of the history of Charles the Bold, of Burgundy, and of the Vehme or secret Inquisition of his era. The characters are numerous and lofty, and some of them powerfully drawn and dramatised.

There is much ability in the composition of this romance it attracts and instructs at the same time; its subject is fresh, diversified, and deeply im prcssive." Nat. Gaz. New York, June 20. Anothtr Bath Failure It is currently reported this morning in Wall-street, that the Farmers and Mechanics' Bank of Pawtucket has stopped payment. It was previously known that some individuals connected with its management, and also largely interested in manufactures, had failed; and likewise that there had been a heavy run upon the Bank on Monday.

It now appears, that altho' it survived the first s'bock, it was afterwards compelled to IT appearing to the satisfaction of the Court, that the defendants A. H. VAN BOKKELIN and RICHARD M. WHITE, Co-partners in trade, underthe firm of VAN BOKKELIN WHITE, are not inhabitants of this State it is ordered that publication be made in the Newbern Spectator, for six weeks, giving notice to the said defendants, that they appear at the Court of Pleas and Quarter Sessions, to be held for the County of Carteret at the Court House in Beaufort, on the third Monday of September next, then and there to replevy and plead to issue, or judgment final will be rendered up against them, and the property levied on, condemned subject to the Plaintiff's recovery.
