The expressed consideration is the $500 note of SpaU-bury Burke, and the $900 note which related to and was male to cover "future advances" to be made. The fact that a consideration for a chattel mortgage is "future advances" does not invalidate it. The manner of the acknowledgment and certification of tbe mortgage is brought in question by intervener.

But it ie not perceived that violence has been done the language or spirit of tbe act relating to such instruments by any of the several steps in the proceeding to chattel mortgage. It may be conceded that the intervener has acquired vested rights in the property in dispute; still theea rights must be held subordinate to the claim of plaintiff, who, as far as the proofs disclose, was not guilty of any frand, illusion or improper practice. The property being of community, the plaintiff had a right to advance money oil its value, and the husband, defendant Stewart, bad a right to dispose of it under the statutory limitation. My conclusion is that, as against the plaintiff, the intervener is not entitled to any reli-f.
