9 Rutland Daily Herald "Saturday Morning, October 3, 1992 State Judge Will Accept Reprimand For Misleading Jury About TV Leahy Rips OMB Ruling on Funds WASHINGTON Sen. Patrick Leahy, addressed a womens rally outside the Capitol building Friday, attacking a government ruling that cuts more than $200 million from breast cancer research. Leahy expressed anger at a ruling by the Office of Management and Budget that breast cancer research funds could not be included in a defense appropriations bills, even though funds for research on prostate cancer were allowed by the OMB. That decision, the senator said, was an act of cruel, mean sexism, and reasoned that generals are more likely to contract prostate cancer than breast cancer. John H.

Dewey Runs for Congress BURLINGTON John H. Dewey, the great-grand nephew of educator John Dewey, has announced he will run for Congress on the platform of the Natural Law Party. Dewey, 46, was the director of flight training at Florida Institute of Technology. He will be on the Vermont ballot for the U.S. House because the Natural Law Party fulfilled the state's ballot access requirements this summer.

Dewey said he strongly endorses the Natural Law Partys policies on energy conservation and efficiency. Technologies exist now to cut energy consumption by 50 percent. This alone would save taxpayers hundreds of billions of dollars and our dependence on foreign oil. The Associntod Pres MONTPELIER A Vermont superior court judge has agreed to be publicly reprimanded for misleading jurors about television coverage of a sexual assault trial. The Judicial Conduct Board has recommended the reprimand for Judge Alden Bryan to the Vermont Supreme Court.

This has been a heartrending case for me, Bryan said Thursday. I felt awfully bad I offended people. Im certainly sorry I offended the jurors. Bryan allowed CBS to set up television equipment in court during last years trial of Todd Streich, 26, of Burlington. St-reich was convicted of sexually assaulting a woman at ward Cashman during the jury selection for another trial: I am dismayed the prosecutor and defense attorney were in collusion about it.

I am dismayed about that this bastion of truth has been violated The 12 jurors in the Streich case signed a written complaint to the Judicial Conduct Board. The jurors also filed complaints with the board about Chittenden County States Attorney William Sorrell, who prosecuted the case, and Burlington lawyer Robert Andres, who defended Streich. The board took no action against them. Bryan and the judicial board agreed that he failed to promote confidence in the integrity and impartiality of the judiciary. But the board also found Bryans explanation believable.

The case won national attention because it involved the use of DNA evidence. Bryan told jurors the cameras were part of an experiment to determine courtroom design for the media. According to court documents, Bryan was concerned that telling the jurors the reason for CBSs interest the DNA evidence would give more credence to it. The judge had decided that it was crucial in protecting the defendants right to a fair trial, court documents said. Many jurors felt that the judge had lied to them and were troubled by the message that this incident sends to the public regarding the importance of the truth, the complaint said.

UVMs Presidential Search Criticized Some said university trustees were concerned about the appearances that Salmon is a shoo-in. He also performs and composes music. Development Secretary Frank McDougall said Davis has extensive administrative experience and knows first-hand the challenges of starting a new business. These are important attributes for this position. Also on Friday, the governor approved of the appointment of Donald Kelpinski to head Vermonts Small Business Development Center, which will be headquartered at Vermont Technical College in Randolph. Kelpinski currently serves as chief operating executive for the U.S.

Postal Service in Vermont. courses. Insiders say UVM doesnt have the time for a year-long search and then another year for a new president to settle in. They feel that UVM cannot remain competitive with other universities while continuing to increase tuition beyond inflation rates. Interim president Thomas Salmon is the only serious internal candidate who has expressed interest in the job.

Luther Hackett, chairman of the board of trustees, said limiting the search to internal candidates, as proposed last month, might violate university and federal laws. We need to know about all the implications, Hackett said. There are laws and regulations that apply to searches that we must obviously comply with. The executive committee of the board of trustees made the recommendation Thursday to the full board to expand the search.

Some trustees and faculty members said limiting the search could hamper the Universitys quest for cultural diversity.
