Defendants named in the complaint are George, Ellis and Michael Boury, owners of the competing chain of Elbys Big Boy restaurants. The complaint, filed by; Marvin Franklin Enterprises, owner of the chain of Franklins Restaurants that Times Classified Ads Will Help You Find A Buyer, Seller, Employer, Employee Phone 348-9157 dot this area, alleges that the defendants plan to construct a new Elby's Big Boy restaurant next to Franklins in Chinchilla would hurt the appearance of Franklin's and damage employee morale. Marvin Franklin, president of the chain of restaurants that bear his name, testified that construction of a new and shiny restaurant and building next to us would make us look bad.

Ironically, the chain of Franklin restaurants in the area, including the Chinchilla restaurant, formerly were operated by Elbys. Testimony at the hearihg indicated that Franklins restaurants in Pennsylvania and West Virginia were operated as Elby's Big Boy from 1966 to 1972. The complaint alleges that a covenant in the deed to the land on which Elbys intends to construct its restaurant in Chinchilla specifically prohibits anyone from conducting a business on the premises specializing in sandwiches. While the covenant does not prohibit the premises from Being used to conduct a business specializing in meals, Franklin's contends that the deed to an adjoining parcel, which Elbys purchased for use as a parking lot, contains separate convenant that does. Attorney Joseph OBrien, representing Franklins, said it is the plaintiffs contention that the Land to be used as a parking lot would be part of the business and, thus, the covenant prohibiting a business specializing in meals would apply to the proposed restaurant as well. Much of the testimony centered around whether Elbys specializes in sandwiches or in meals.

Testimony in the case was expected to be concluded later today. Under cross-examination by Stahl's attorney, public defender Joseph McGraw, both youths admitted Stahl used no physical force on them during the photo session and both said they agreed to pose for the pictures because Stahl promised them they would be paid. have to pay almost double for the installation of any new fire hydrants. The letter stated that all installations after June, 1982, would cost $182, as opposed to the $99 the township currently pays. Cole said he would investigate this delayed notification, since the township made numerous requests prior to last June, and was neither notified then of the rate increases, nor was granted the additional installations.
