S' 1 rrrTr -v .32 OjiUabZiiffrlbunt July 22, 1 970 Hotel Guest Luggage Seizures Restricted Cities Check Census Bail for LSD King Is Revoked cision banning wage garnishment and property seizure without prior public hearings. Stephen Klim, 37, a parttime painter living at the Junior Tar Hotel, 3143 16th SL, San Francisco, had sued the hotel after he was locked out of Innkeepers to California may not seize a guests belongings without a hearing for non-payment of rent, Federal District Judge Gerald S. Levin has ruled in San Francisco. Levin based bis ruling on a 1969 U.S. Supreme Court de Two Bay Region dties Rosa and San Carlos begun thelaborious process of a missing persons to determine whether preliminary 1970 census figures are accurate.

I Three other cities Lafayette, San Pablo and Menlo Ipark are considering making such a missing persons Icheck, and the city of El Cer rito has asked for a computer check of housing records which would indicate whether the city's population total is accurate. Evan Davey, Northern Cali fornia-Nevada region director of the U.S. Census Bureau, said protesting dties are required to conduct their own survey to turn up people who werent enumerated on the April 1, 1970 Census Day. He said the Census Bureau provides forms and under normal procedures all local city employes and members of dvic groups would contact friends and neighbors looking for people missed bv the census. Blank census forms are also placed In grocery stores and places of public assembly.

The forms for any missing people found in the survey are sent to the Census Bureau's huge data banks of confidential personal information in Jeffersonville, to' determine whether the missing people actually were missed on Census Day, be said. If this recheck verifies that some people actually were missed in the national head-count, then a city's population total will be readjusted, Davey said. Most city officials dont realize how difficult and time consuming a process it is, Davey said. He said people who volunteer to fill out a missing person form are usually people who got counted on Census Day. People who wanted to be missed on Census Day are likely to stay missing, be his room, and his belongings seized, when he -fell behind in his $10 a week rent.

Judge Levin noted that landlords have the attrae-five alternative" of requiring advance payment to assure against loss of rent. (WI I Augustus Owsley Stanley in, 35, reputed East bay LSD knlg, Is to federal custody af ter hia $35,000 ball on a nar-coticj conviction was revoked yesterday. Federal Judge William T. Swelgeit remanded Stanley to custody, calling him a danger to the community and adding there was a risk of flight" Should Stanley win freedom through an appeal, the judge set new bail at $70,000 on the basis of new charges. Stanley has been twice arrested and charged with narcotics violations since last November when he was sentenced to three years to prison and fined $3,000 to federal court Stanleys attorney, Michael Metzger, said he will seek a review by.

the U.S. Circuit Court and also appeal to the Supreme Court Judge Swei-gert said an appeal to the Supreme Court on the reasons given him would be frivolous or merely for delay. Last January Stanley was one of 19 persons arrested to New Orleans. Last week be was arrested in Oakland at 6024 Ascot Dr. and charged with three counts of possession of illegal drugs.

On June 1 the court of appeals affirmed his conviction and denied him a rehearing. His appeal is now complete, Judge Sweigert said as he ordered him to prison. Masquer Musical little Mary Sunshine, the musical by Rick Besoyan, opens Friday at 8:30 pm. at the Masquers Playhouse, 105 Part: Place, Point Richmond. It will run Fridays and Satur-days through August.

68 AIU1-100 Fnn Santa Rosas population jumped from 31,027 in 1960 to 48,464 in 1970, and San Carlos jumped from 21,370 to 22,787, but the city fathers in both cities still feel the census figures are too small. Lafayette, with a 1970 population of 19,797, San Pablo, with 21,370, and Menlo Park, with 26,445, have asked Dav-eys office for Information about how to conduct a missing people survey, but havent, actually launched the process. El Cerrito, whose population declined from 25,437 to 24,865 in the past decade, is making a somewhat more sophisticated challenge of the accuracy of the census, according to Mrs. Joza Dailey, the dty planning director. Mrs.

Dailey said that unlike most cities, El Cerrito keeps its own accurate up to date records on the number and types of dwefiing units in the city. In 1960 there were 8,100 dwelling units and in 1970 there are 9,100, she said. El Cerrito has asked the Census Bureau to run a special total on the number of. housing units in the citys eight census tracts. This particular bit of census data wouldnt normally be compiled and published until next year.

If the Census Btreau housing figure agrees with the citys housing figure, Then well probably have to assume that the citys census figure is correct, Mrs. Dailey said. In that case, die said, the only logical answer would be that El Cerrito families are getting smaller and there are less people living in more -dwelling units. But if Census Btreau housing figures come out significantly shy of the citys bousing records then El Cerrito would be able to make a strong case in demanding a recount of the citys population, she said. The Census Bureau has now issued preliminary population figures for 84 of the 91 Bay Area dties.

Opera Will Keep LA. Date LOS ANGELES (UPI) -The traditional appearance of the New York Opera Company at the Dorothy Chandler Pavilion this November and December will take place after all. The Music Center Opera As-sociation announced two weeks ago that the engagement had been canceled, but held out the thin hope that the season could be saved if $300,000 was raised to wipe out defidts. Association Chairman John A. McCone said yesterday the money is being raised and the engagement is on again.

Some of the money came in form of contributions but the biggest lift was $100,000 to public subsidies voted by the county board of supervisors.
