The nephews In attacking the will contended that prior to his death in 1939. Gimbel had been in several hospitals for illnesses which sapped his physical and mental strength to such an extent that his testamentary capacity was affected. The appeal proceedings have been before the court for several months at the Brooklyn Eye and Ear Hospital, with which he was associated all his active career. was formerly a member of the Medical Society of the County of Kings the Brooklyn Ophthalmo logical Society, the American Medical Association and the Hamilton Club of Brooklyn. He also had been for many years an active member of St.

Ann's Episcooal Church In Brooklyn, and served as its treasurer. Surviving are his widow, Sophie; a daughter, Mrs. Thomas and two brothers, Clarence Simmons of Copake, N. Y. and Elmer Simmons of Millerton, New York.

Mr. Hemberger died yesterday. He had lived recently at 5fi7 Eastern Parkway. He was born in Germany 62 years aao and had lived in this country 58 years, most of that time 'In Brooklyn. Until he retired 15 years ago, he was active in the building business In Coney Island and built many of the large fine homes in Sea Gate, where he lived for 20 years.
