DECISION AGAINST O'ROURKE Controller Walton Sustains the Objections Raised to the Payment of the Contractor's Warrant. Controller Walton yesterday rendered a decision in tbe case of Contractor Michael O'Ronrke against the payment of warrants, to which the' Citizens' Municipal Association had filed objections. The Controller decided that these objections were sustained, and returned the warrant to Director Thompson without bis The work which O'Kotirke hud con: traded for was the grading of Grant to the specifications for this work there was the following special notice: "lu submitting proposals for the grading of Grant street, from Academy road to N.

Y. division. V. K. bidders will take notice that the price per cubic yard for the grading must Include the construction" of the necessary fcewers, drains and bridges, and reniae-adniniziug, and all other work incident to the grading, without additional allowance or compensation." Air.

O'Kourke got the contract for but subsequently Councils passed an ordinance allowing him more, and it was to the payment of this that objection was made. O'Kourke. in his statement, said that the special notice was not attached to the proposal before he submitted bis bid, and asserted that he signed the contract order to prevent his name from being placed on the ''black-list" as a defaulting contractor. This signing of Contractor Walton considered fatal to Mr. O'Kourke, and he accordingly refused to approve the warrant.
