Proceedings of the Board of Commissioners Regular Meeting of Board of Commissioners was held in the City Hall Tuesday, February 19, 1957 at 8 p.m. Mayor -De Muro in the Chair. On call of roll, the following named Commissioners responded: Cinamon, Cruise, Manney, Pashman and De Muro 5. On motion, the Excise Board convened. On call of roll, yeas 5: Cinamon, Cruise, Manney, Pashman and De Muro.

Joseph Socieded Santiago, Treasurer, De advising that the Hispano Passaic would like to withdraw its application for club license filed on February 1, 1957, and requesting the return of the filing fee of $59.18. Received and filed, the fee to be returned. On call of roll, yeas 5: Cinamon. Cruise, Manney, Pashman and De Muro. WHEREAS, application has been made to the Board of Commissioners to transfer to Ann De Vries, Harrison House, for premises located at 888 Main Avenue, Passaic, New License Jersey, the Retail Consumption No.

C-45 heretofore issued to Charles Darder Michael Darder, Darder's Bar Grill for the premises located at 888 Main Avenue and due notice of said application having been made and no objection having been made thereto, is, therefore. on the 19th day of February, 1957 on motion duly made and seconded, RESOLVED and ORDERED, that said application be approved and that Plenary Retail Consumption License No. C-45 heretofore issued by the Board of Commissioners to Charles Darder Michael Darder, Darder's Bar Grill for premises at 888 Main Avenue is hereby transferred, effective February 19, 1957, to Ann De Vries, Harrison House for premises located at 888 Main Avenue. RESOLVED and ORDERED, that said application be approved and that Plenary Retail Consumption License No. C-102 heretofore issued by the Board of Commissioners to Edward J. Hollar William C. Carter, The Lantern Bar Grill for premises al 57-59 Garden Street is hereby transferred, to William C.

CarterWilliam V. Kimak. The Lantern Bar de Grill for premises located at 57-59 Garden Street; Subject to: The special condition that the transfer shall not be endorsed and effective unless and until two (2) whole days have elapsed after the second publication of Notice of Application, not counting the day on which second publication may be made; and if within such period or at any time before the transter is endorsed written objection to the transfer is filed, the transfer shall not be endorsed and effective pending the further determination of the issuing authority, Adopted. Passaic Planning Commission, advising that they cannot approve the ordinance or the proposed change thereof respect to Main Avenue between Howard Avenue and Brook Avenue.

An Ordinance was introduced entitled "An Ordinance To Amend An Ordinance Entitled 'An Ordinance, Establishing A Comprehensive Zoning Plan For The City Of Passaic By Dividing The Territory Thereof Into Various Districts And Prescribing Certain Regulations For Each Of Said Districts. On call of roll, yeas 5: Cinamon, Cruise, Manney, Pashman and De Muro.

Chairman of the Zoning Committee, August Michaelis, advising that the Passaic Planning Commission, after a public hearing, recommended adoption of new ordinance changing the area contained in the description from R-30 district to C-1 district in the ordinance for Myrtle Avenue, Burgess Place and Highland Avenue. regarding proposal to add regulations to the State Sanitary Code, which will materially increase the cost of refuse collection. Received and filed, and referred to the Director of Public Works. Sullivan has been elected Secretary of the Commission for the year 1957 and requesting that his compensation be fixed and manner of paying same, Received and filed, and compensation fixed at same rate as previous year.

Director of Local Government, grantIng permission to contribute the sum of $1,500.00 of surplus funds to be used as an item of revenue in the 1957 budget of the City of Passaic. Received and filed. From the Board of School Estimate, the following: This is to certify that at a meeting of the Board of School Estimate held in the City Hall on Thursday, February 14, 1957 at 8:00 p.m., the following resolutions were adopted.

WHEREAS, The Board of Education has submitted its budget and has estimated the sum of TWO MILLION SEVEN HUNDRED FORTY-EIGHT THOUSAND SEVEN HUNDRED EIGHTY TWO DOLLARS AND TEN ($7,748,782.10) to be necessary for the operation of the public schools of the City of. Passaic for the school year beginning July 1957, exclusive of state, county, federal and other funds, be it RESOLVED: That we hereby fix and determine the amounts to be raised as follows: For Current Expenses, Repairs and Refurnishing, the sum of $2,638,026.24 For Evening Vocational Training. the sum of 184.50 for Evening School Born, the sum of 5,530.00 Total amount to be raised is $2,643,740.74 RESOLVED: In accordance with Statute R.S. the following calendar year requirements for the year 1957 are hereby certified to be raised by taxation in the 1957 budget of the City of Passaic: January 1 to June 30, 1957 (one half of the 1956-57 levy) $1,279,595.00 July 1 to December 31, 1957 (one of the 1957-58 Levy) 1.321,870.37 Total Calendar Year 1937 Requirements $2,601,465.37 RESOLVED: That the Secretary is hereby instructed to prepare two certificates of this action. one to be sent 10 the Board of Education and the other to the Board of Commissioners.

Mr. Frederick Wells, regarding salary be adjustments for City employes to made comparable to salaries paid to same class of employes in other industries, which should be done by reducing expenses wherever possible. Herman D. Hillman of the Public Housing Administration respecting certain comments contained in his letter of February to the Housing Authority. Received and filed. City Counsel to Commissioner advising that Mrs. George (Dorothy) Rosenstone, owner of Lot 23 Block 174 Jackson Street, has that tax lien foreclosure proceedings be deferred pending payment of existing tax liens and accruing taxes in monthly installments, and enclosing check for $500 covering the initial installment payment. The City Counsel recommended that proposal offered be accepted and the foreclosure proceedings be held in abeyance so long as the installment payments are promptly made.

Commissioner Pashman, regarding the Erie the Citizens Advisory Committee on Tracks project, and advising of his opinion that the scope of the Committee should be expanded to include not only the track elimination phase but also the phase covering the acquirement of the right of way and recommendations for the use thereof, and that he has requested the preparation of a supplement to the previous resolution broadening the scope of the work of the Committee. WHEREAS by resolution adopted October 23, 1956, the Board of Commissioners created a Citizens Advisory Committee which was charged with the duty and responsibility of consolidation studying all of phases the proposed rights of way of the D. in L. and Erie area Railroad effect the Companies elimination the Passaic to tracks from Main Avenue and the central business district of the City of Passaic; and WHEREAS it is the judgment of this Board should be that the expanded scope to of include the all Committee phases proposed project.

RESOLVED, by the Board of Commissioners of the City of Passaic that in addition to the duties and responsibilities imposed in the Committee under the resolution aforementioned the Committee shall have the duty and responsibility studying all phases of the acquisition of the Erie Company right of way which will be made available by the track elimination and phases of the use to which such right way should be dedicated in the best interests of the City of Passaic. the purpose and intent of this resolution that the studies hereunder authorized shall include all elements the overall problem that can be reasonably said to affect track elimination, acquisition of the right of way and the use thereof. mittee FURTHER shall advise RESOLVED and assist the Board Commissioners in the formulation an appropriate policy with respect the matters aforementioned and that end the Committee shall submit such reports from time to time as may necessary and requisite. Mayor De Muro, advising that an invitation has, been extended to the Board of Commissioners to attend military review on Sunday, February 24th at p.m. in the Paterson Armory, Combat Command to present all the Natonal Guard units in northern New Jersey to the public. Mayor De Muro, advising that extra copies of deeds of Passaic properties can be had from the County Register of Deeds for 50 cents each, approximating $300.00 per year, which would eliminate the work of typing and checking extra copies as has been done previously by the Engineering Department and the Assessor's office. Cruise, Manney, Pashman 'and De Muro, Commissioner Pashman, submitting Resolution covering advance of $28.000.00 granted by the Community Facilities Agency of the Federal Government for preparation of plans for improvements recommended by the Planning Commission and approved by the Board of Commissioners. This resolution supplements the one adopted last October covering the 000.00 advanced for preparation of plans for the bus terminal and traffic and parking project, which plans Commissioner Pashman proposes to proceed forthwith for the several projects on an integrated basis.

Commissioner Pashman, advising that he has received official notification that the Civil Service Department has recorded the creation and approved the classification of the position of Chief Assessing Clerk in the Competitive Division of the Classifled Service, and further advising that he is hereby appointing Mr.

Alfred Greene, Jr. temporarily to the position of Chief Assessing Clerk, pending an open and competitive examination. Received and filed. and action approved. On call of roll, yeas 5: Cinamon, Cruise, Manney, Pashman and De Muro.

WHEREAS, there appears to be insufficient funds in the following accounts, excepting the appropriation for Contingent Expenses, Deferred Charges. to meet the commitments of 1956: WHEREAS, there appears to be a surplus in the following accounts (exceptthe appropriation for Contingent Expenses, Deferred Charges, Payment of Floating Debt. Reserve for Debt Uncollectable Taxes, or Interest and Redemption Charges) over and above the amounts necessary for the commitments of 1956: R. F. 10.

RESOLVED: that in accordance with provisions of Article R.S. as amended, part of the surplus in the accounts heretofore mentioned be and the same are hereby transferred to the accounts (excepting the appropriation for Contingent Expenses, or Deferred Charges) mentioned as being insufficient to meet these commitments, and BE IT FURTHER RESOLVED, that the City Treasurer be and he is hereby authorized and directed to make the folflowing transfers: From R.F. 10 O.E.., $687.50. To P.P. O.E,.

WHEREAS: the building on premises known as Lot 27 in Block 103, No. 327 Highland Avenue, Passaic, New Jersey, and assessed to Morwill Realty was demolished before October 1st. 1955, and WHEREAS, the Assessor of the City of Passaic allowed a reduction in the assessment of said premises therefor, and the said taxes for the year 1956 became $14.66 and WHEREAS, the said Morwill Realty Co.

the owner of said premises, paid taxes thereon for the year 1956 in the amount of $60.11 which was $45.45 in excess of taxes for said year of 1956. THEREFORE, BE IT. he RESOLVED, that the City Treasurer be and is hereby authorized to make refund of said overpayment of $45.45. to said Morwill Realty Co. Inc.

WHEREAS the Housing and Home F1- nance Agency (Community Facilities Administration) has approved Passaic the aid application of the City of for in financing the cost of plan preparation, to consist preliminary planning including engineering, surveys, foundation exploration, studies, layouts, reports and cost estimates for the proposed construction of certain improvements in the City of Passaic, being project No. N. J.

28-P-3016, and has agreed to advance not exceeding the sum of $28,000.00 for that purpose. pursuant to the provisions of Public Law 560, 83rd Congress, and subject to the terms and conditions of the Agency: RESOLVED by the Board Passaic of Commissioners of the City of that the offer of the Government as aforesaid be accepted and that the Director of the Department of Revenue and Finance be and he is hereby authorized, directed and empowered, for and in behalf of the City of Passaic, to execute the agreement with the Housing and Home Finance Agency submitted herewith and to do all things necessary and proper to perform the terms of said agreement, pursuant to Jaw. and BE IT FURTHER RESOLVED that the 1957 Municipal Aid Schedule of Work, form MA-1-7M-11-54 as submitted to the PROJECT Division of the Highway Department of the State amounts of New set Jersey be approved and the as forth in said Schedule are included in 1957 budget for use during 1957 and the repair and maintenance of roads. AND BE IT FURTHER RESOLVED: that the Director of Public Works, Municipal Engineer. City Treasurer City Clerk, be authorized to sign and execute the Municipal Aid Schedule of Work, the Certificate of Expenditure and such other forms, reports and papers necessary to make application for and use cf State and Road Funds AND BE IT FURTHER RESOLVED: that the State Highway Department forms for specifications, general requirements and proposals be hereby approved and used in the work of street maintenance and repairs under the State Aid program. Wife Free in Charge Of Mate's Fatal Burns (UP) -A houseindicted on charges of killing her husband by dousing him a with turpentine and striking match, was found innocent yesterday by an Essex County Court jury. Julia Stoneback, 69, was charged with setting her husband on fire last October 15 in the rooming house she operates. Paul Stoneback, 60, died December 31 of bronchial pneumonia resulting from burns. Mrs. Stoneback, who broke into a broad smile at the verdict, maintained her husband set fire to himself.

A defense witness, Detective John Walker, said that in a hospital interview Stonetold him he accidentally touched off the flames in lighting a cigarette. Heyn HOLLYWOOD (AP) -The once played never screened an unhappier finale. In Shabby Cottage Her name has Dorothy Dale, a beautiful actress more than 30 years ago until her features, so often admired, so often photographer, became badly scarred.

At the end she was a recluse, hiding her face behind a heavy veil, living in a shabby, memento-cluttered cottage. Fiery death wrote the final act yesterday. Her real name was Mrs. Alida Hyman, 74, and one of her roles was in "Foolish Wives" with Erich von Stroheim who died Sunday. Mrs.

Hyman perished, firemen said, when her little home was set ablaze by an old-fashioned gas heater placed too close to a frayed overstuffed sofa. Mrs. Hyman had lived alone in the cottage, at the rear of a weed-grown lot, since her husband died in 1942. He was Dr. Jacob Hyman, one-time magician, physician and Baptist minister.

The few friends and relatives who still saw the erstwhile Dorothy Dale in her last years knew her as an eccentric who always went veiled on the rare occasions when she left her home. Her face was scarred ed, by makeup poisoning years ago. Mrs. Edward Walthers, Husband Died Recently PATERSON Mrs. Margaret Walthers, 63, of the Alabama Avenue housing project, died yesterday after a long illness.

Her husband, Edward Walthers, died five months ago. Mrs. Walthers was a native of this city and a member of Helen Kearney Circle of the Foresters of America. Surviving her are a brother, William Curry, and a sister, Mrs. Mary Martin, both of Paterson.

Mrs. Walter Kirk, 62, Former Clifton Resident POINT PLEASANT Mrs. Mary Kirk, 62, former Clifton resident who resided with her daughter, Mrs. Le Roy Hilton, of Kenneth Road, died yesterday in Fitkin Memorial Hospital, Neptune, after a long illness. Born Brooklyn, Mrs.

Kirk had lived in Clifton many years before moving to Point Pleasant several years ago. She was a member of Faith Chapter, OES, of Point Pleasant, and of the Point Pleasant Presbyterian Church. LONDON (AP) Sir Sidney Abrahams, 72, former chief justice of Ceylon and one of three famous British athlete brothers, died today. Abrahams represented Britain in the 100-meter race and broad jump at the 1906 Athens Olympics and in the broad jump at Stockholm in 1912. His younger brother, Harold, won broad jump gold medal in the 1924 Paris games.
