Hightower at Cleveland on the Hth inst. The motion was sustained, but the cause was continued over for final hearing at the regular term of court in August. Judge Hightower, so the Vindicator is informed, held that the plaintiff. W. S.

I'artlow, had no such interest in the county funds as entitled him to bring the suit. The merits of the case, other than the right of the plaintiff to bring the action, were not passed on. Following we give a summary oi the allegations, and answers thereto, as prepared by J. K. Dabney and Ralph Wright for the plaintiff and H.

E. Marshall for the defendants: ist. That plaintiff is a resident, a property owner, a taxpayer and a qualified voter til Liberty county, and that defendants are residents of I.ilierty county. That on the day of May, 1906, T. C.

Crane, county judge, advertised in the Liberty Vindicator that bids woultl be received on the 1 1 th day of June, 1906. for the depository of the county funds, which notice was given for the time required by law. on the 11 th day of une, 1906, the Liberty County Hank delivered to T. C. Crane, county judge, a bid offering 3 per cent for said funds, and complied with the law in other respects That Jos.

Pruett and Frank Abshier, county commissioners, are also kholders and directors of the I ir-t State Hank of Liberty; That the court met on the 11 tli of June, 1906, to consider bids lur county depository, and that there were present and at ting I'.
