A3 Fremont Tribune, Friday, March 30, 1IM Judges consider testimony in Douglas impeachment sion would take some time because the voluminous record which includes thousands of pages of documents and transcripts must be reviewed. The court is still considering a renewed motion from Morrow to. dismiss the proceedings and acquit Douglas. Kopf said he would file a document tracing some of Douglas financial transactions by next Monday. The defense will have an additional three days to file its response.

A conviction would require affirmative votes from five of the seven judges and could remove Douglas from office and dsiqualify him from ever again holding public office in Nebraska. Douglas, a Republican once viewed as a possl- Prosecutor Richard Kopf said the evidente showed "to a moral certainty that Douglas, 56, was guilty of one or more of the six specific offenses cited in the articles of impeachment adopted by the Legislature March 6. Attorney William Morrow representing Douglas, told the court the impeachment from the Legislature was returned as a political matter based on inference, innuendo and insinuation. He said the evidence failed to show Douglas had broken the law or breached his official duties. Four judges of the state Supreme Court and three lower court judges heard the case.

Speaker of the Legislature William Nichol of Scottsbluff said he hoped the courts ultimate decision would be accepted as the right decision, even though it might not agree with everyones individual views. It should be said that the process has worked in an orderly fashion and the case has gone to the highest court in the state, Nichol said. What amazes me is that they whipped it through so fast. I thought it would take weeks.

I hope the decision comes soon. In criticizing the states case, Morrow referred to news coverage of Douglas involvement in Commonwealth. He said newspaper stories gave erroneous impressions about Douglas activities. I thank God that were in a court where that cant happen, Morrow said, in a voice choked with ble candidate for the U.S. Senate or the governorship, is in his third four-year term.

Attorneys for the state and the attorney general gave their final arguments Thursday after concluding their respective cases. Kopf charged that Douglas misled or lied to Investigators, aided and abetted an insider loan, failed to investigate Commonwealth and Marvin Copple, failed to disqualify himself when he should have and failed to avoid the appearance of Impropriety. We expect and demand that as an attorney and an attorney general he has an obligation of absolute candor and Douglas failed that obligation, Kopf said. Kopf said Douglas had a supreme obligation to avoid even the appearance of impropriety. Whether or not Douglas conduct was criminal, Kopf argued, he breached his duty to the public to a degree requiring his removal from office.

Kopf said Douglas failed to disclose the "Intensity of his involvement with Marvin Copple, and that then-Banking Director Paul Amen was entitled to know whether Douglas could zealously represent him in the Commonwealth matter. Morrow argued that Douglas disqualified himself at the appropriate time, that he handled the Commonwealth situation properly until Senators override budget vetoes Attorney General Paul Douglas then, and that his business transactions were neither illegal or uncommon at Commonwealth. The governor had made no secret tjiat he wanted to trim the budget below (800 million in order to free funds for education and economic and water development projects. However, several items included in the committees package later were restored as lawmakers offered a parade of motions to override the governor. A motion by Sen. Harold Sieck of Pleasant Dale to restore (1.59 million in state payments for mental retardation assistance won overwhelming approval.

The motion, adopted 44-3, collected hearty endorsements from a series of lawmakers who said it could reduce state welfare payments and give a ray of hope to the mentally retarded. The debate turned emotional when senators accepted a motion by Sen. Vard Johnson of Omaha to override Kerrey's reduction of (1.4 million from the Legislatures budget. A few lawmakers, lambasted the governor for his response to a recent question on whether he would request a special legislative session to bail out Commonwealth Savings Co. depositors.

Kerrey said he would not seek a special session and added that he slept better when the Legislature was not meeting.
