Thursday, April 30, 1987 FremontTribune State B7 Cloan Indoor Air Act debated LINCOLN (AP) The Legislature took up debate on a measure designed to strengthen the Nebraska Clean Indoor Air Act, a law even its most ardent supporter says has been widely disregarded. Lawmakers adjourned Wednesday before taking first-round ac tion on LB9S, which is sponsored by Sen. Shirley Marsh of Lincoln. The bill, which was drastically revised by the Legislatures Health and Human Services Committee, would require proprietors in charge of public places to post signs designating non-smoking areas. The amended version of LB95 also would require employers to adopt and enforce written workplace smoking policies and would institute a civil penalty of 9100 per day for violation of the bill.

The cumulative penalties could not exceed $500. Mrs. Marsh said the measure is needed to make the Clean Indoor Air Act effective. She has been a leading proponent of the law. The basic premise of the present act is that smoking is prohibited in public places, including places of employment and areas used by the general public, except in designated smoking areas, she said.

However, the law is widelydisregarded. One reason the law is ineffective is that proprietors arent required to post signs designating non-smoking areas in public places, Mrs. Marsh said. Under the bill, which advanced 26-0 on Wednesday, shoplifters or their parents could be required to pay their victims actual damages as well as court costs and attorneys fees. The bill would give merchants an alternative to criminal prosecution of shoplifters, which ties up courts, Mrs. Pirsch has said.

Shoplifting, continues to increase, she said, and its costs are split by merchants and their customers. Lawmakers adopted an amendment' that removed part of the bill that would hold the state responsible for paying for its wards shoplifting crimes. The original bill considered parents responsible for children 18 and under, but amendments adopted earlier lowered the age of those considered minors to 16 and under. Sen. Ernest Chambers of Omaha, who opposed the bill during earlier debate and had offered an unsuccessful motion to kill the bill, was absent.
